SERVATION OF THE PUBLIC PEACE, HEALTH AND
SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters`60 to 64,
inclusive, of the Saint Paul Legislativg Code, pertaining to
Use Districts, Height Districts, and Rezoning of certain pro-
perties in the City of Saint Paul, as amended, be and the same
is hereby further "amended so as to rezone the following des-
cribed property from "B" Residence District to Commercial
District, to -wit
"Lots 3, 4 and the east 14 ft. of Lot 5,
Zachrison's Addition;"
situated on the south side of Maryland Ave. between Arkwright
and Clark Sts. in Saint '^Paul.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of the
_.public peace, health, and safety.'
Section 3. This ordinance shall take effect'and be in
force upon its passage, approval and publication.

Dear Sir:
This is in the matter of the petition of Leo J. Sokola to rezone
from "B" residence to commercial district, property located on the
south side of Maryland Avenue between Arkwright and Clark Streets
which is described as Lots 3, 4, and the east 14 feet of Lot 5,
Zagison's Addition.
On February 25,11964, the Commissioner of Finance reported the
petition sufficient with the owners of 12 of a possible 18 (66.66%)
tracts of land within the prescribed 100 foot radius having sigged
the petition. The property is developed with a single - family resi-
dence which the7applicant proposes to move and to combine the subject
property with the commercially zoned property adjoining to the west
for the purpose;;of constructing a filling station. The subject pro-
perty has a frontage of 90 feet on the south side of Maryland Avenue
and a depth of 121.5 feet, resulting in a total area of 10,935 square
feet. `
The Board of Zoning considered this matter at its regular meeting
on March 5, 1964. It was pointed out that the area is developed, `
residentially with the exception of a neighborhood store at the
northeast intersection of Arkwright Street and Maryland Avenue
although the'fdur corners of the intersection -are commercial and
have been since the•enactment� =of the Zoning-0rdinance in 1922. After
hearing the staff report and'the petitioner, the Board recommends
denial of the petition to rezone the above described property to a
commercial district and further wishes to state that it is the Board's
considered opinion that a filling station at this location would be
incompatible with the existing area uses.
