This is in the matter of Fredri'c� J. Eichinger and Wm. H. Weitzman's

back to the facade of the proposed building �rom Jefferson Avenue and a
4 foot setback for the building wingwalls from Jefferson Avenue and a
- - zero (0). foot setback from Jefferson Avenue for the retaining walls, and
2) an application�'for a 78 car off-street parking facility in conjunction
with a proposed 55�. unit apartment building to be constructed on property
located at the northeast corner of Jefferson Avenue and Lexington Parkway.
� The legal descript'ion of the subject property is a miscellaneous one, a '
copy of which is attached. This property was rezoned to a "C" residence
district on August��31, 1963. ,

The site is now vacant and is an irregularly shaped tract of land having
� a frontage of 326 feet on the east side of Lexington Parkway and 356 feet
on the north side of Jefferson Avenu� resulting in an area of approximately
75,000 square feet 'of which 62,600 square feet is usable, the remainder of
the site will consist of slopes to the service road of the Short Line Route.
Because of the size�.,and shape of the subject property, the City Architect
• deemed it advisable;`for the applicant to ask the City Council to determine
- the setbacks along the two adjoining streets.

The Board of Zoning ''considered this matter at its regular meeting on Feb-
ruary 20, 1964. The`Board heard the reportof the staff that the proposal
met the requirementsaof the Legislative Zoning Code pertaining to building
' ground coverage and density, and that the .Traffic Engineer has approved the
parking lot layout arid driveways which also meet the 'requirements of the
off-street parking regulations., It was pointed out that the requested set-
backs are reasonable,� and will not have a detrimental effect on the single-'
. family residential development to the south and southwest, and, for the mcsst
' part, the off-street parking facility will not be visi.ble from the street
intersection. In consideration of these factors, the Board of Zoning re-
commends the granting',;of the setbacks as above outlined, and the off-street
� parking permit in accordance with final plans dated April 1, 1964.

Gentlemen:
Reference is made to the application of the above named persons for a
parking lot permit for a proposed 55-unit apartment building on the above
described property, the legal description of which is attached hereto
and made a part hereof. This application is on the agenda of the Zoning
Board for Thursday, February 20, 1964. There was filed with said appli-
cation three sets°of plans of the parking lot layout which plans also show
the building lines of the proposed building. ' '
In view of the triangular shape of the parcel, and in view of the lack
of clear application of the setback provisions of the applicable ordinances,
, it is desired to have the minimum required setbacks from the property lines
on all sides determined.
Therefore, this letter shall constitute an appeal from the application of
the provisions of the Legislative Zoning Code to said parcel taken under
Section 64.03 (j) of the Legislative Zoning Code for the purpose of deter-
mining all minimum setback lines. It may be the intention of the developers,
if permitted by the ultimate decision on this appeal, to move the building
,_,� lines as shown on said plot plan of the building somewhat closer to either
i Lexington Parkway� or Jefferson Avenue, or both.
