06-874Counci� Fi�e # D6-87<{ Green Sheet # 3032449 RESOLUTION 3D CITY OF,/SAINT PAUL, MINNESOTA Presented By Referred To Committee: Date RESOLUTION APPROVING THE AMENDMENT OF TAX INCREMENT FINANCING PLAN FOR CARLETON LOFTS TAX INCREMENT FINANCING DISTRICT BE IT RESOLVED by the City Council of the City of Saint Paul, Minnesota (the "City") as follows: Secrion 1. Recitals 8 1 Al. The Housing and Redevelopment Authority of the City of Saint Paul, Minnesota 9 (the "Authority") has heretofore, with the approval of the City Council of the City of Saint Paul, 10 Minnesota (the "City"), adopted a Redevelopment Plan (the "Redevelopment Plan") for the West 11 Midway-South St. Anthony Park Redevelopment Project (the "Redevelopment Project Area"), 12 pursuant to Minnesota Statutes, Sections 469.001 to 469.047, both inclusive; and 13 1 A2. The City and the Authority have heretofore approved and created by resolufions 14 of the City and Authority, (collectively, the "Prior Resolutions), within the Redevelopment 15 Project Area, the Carleton I,ofts Tax Increment Financing District (the "Tu� Increment DistricY') 16 and adopted a Tax Increment Financing Plan therefor (the "Taac Increment Plan"), all pursuant to 17 and in accordance with Minnesota Statutes, Section 469.174 through 469.1799 (the "Tax 18 Increment AcY'). 19 1.03. The Authority has deYermined that it is necessary to amend the Tax Increment 20 Plan to correct the legal description and the parcel identificarion numbers of property located in 21 the Tas Increment District. The Authority has performed all acrions required by law to be 22 performed prior to the amendment of the Taac Increment Plan, including, but not limited to, 23 notificarion of Ramsey County and Independent School District Number 625, which have taxing 24 jurisdiction over the property included in the Ta�c Increment District, and has requested that the 25 City approve the Amendment of the Taz Increment Financing Plan following the holding of a 26 public hearing upon published and mailed notice as required by law. 27 1.04. On this date, the City Council conducted a public hearing on the adoption of the 28 Amendment of Tax Increment Financing Plan, after published notice thereof; and 29 1.05. At said public hearing the City Council heard testimony from all interested parties 30 on the Amendment of Ta�c Increment Financing Plan. 1938795v] o� - g�� 31 32 33 34 35 36 37 38 39 40 41 42 43 44 Section 2. Findings for the Amendment of the Tas Increment Financin2 Plan. 2.01. The City Council hereby finds that the Amendment of TaY Increment Financing Plan dated September 27, 2006 (the "Amendment of Taac Increment Financing Pian") is intended and, in the judgnent of the City Council, its effect will be, to cazry out the objectives of the Redevelopment Plan and to create an impetus for the redevelopment of blighted areas and wiil otherwise promote certain public purposes and accomplish certain objecrives as specified in the Redevelopment Plan and Taic Increment Financing Plan, as amended. 2.02. The City Council hereby reaffirms the findings heretofore made that the Cazelton L,ofts Tax Increment Financing District qualifies as a"housing district" within the meaning of the Tas Increment Act. 2.03. The City Council hereby reaffirms the findings made by the City Council in its Prior Resolution. 2.04. The provisions of this Secrion 2 are hereby incorporated by reference into and made a part of the Amendment of the Tax Increment Financing Plan. 45 Section 3. Annroval of Amendment of the Tax Increment Financine Plan. 46 3A1. The Amendment of Tas Increment Financing Plan for Carelton Lofts Tas 47 Increment Financing District dated September 27, 2006 is hereby approved. 48 3.02.
