Dalglish Department of F inance Building Dear Sir: In connection with the assessment of bene- fits for improving.�hepard Road from James �venue to Otto Ave- nue, under� Council File No. 1991��1, approved Oetober 25, 1960, I find that, in the assessment roll as submitted to the council a.nd approved by Council File No. 216998 on March 10, 196l�, an assessment for ornamental lights in the amount of �1,262.90 �as included against the miscellaneous tract in Gavernment Lot l�, Section 12'�, Township 28, Range 23, owned by the Chicago, St. Pau1, Minneapol is and Omaha Railway Compar�y. � Shepard Road at this point is built on land acquired from said railroad, and it appears that at the time of the condemnation, as evidenced by a letter written by A�Lrr. George Shepard, Street and Highway Engineering Coordinator, that as part of the acquisition costs no assessment would be lzvied against the � remainder of the tract for the ornamental lights. This agreement was based 'paxtly on the award agreed to at the time and partly on the faet that the rema.inder of the parcel lies considerably above the el evation of Shepard Road, and consequently, the lights were installed primarily to illuminate the roadway prop�r. __ I, th erefore, request that you sponsor the attached r..esolution which will eliminate the assessment for the ornamental lights as it appears on page 7 of the assessment roll for the above improvement.
