' RESOL�IED, upon consideration of the pertinent application therefor
by Milton M. Miller, owner of the sub�ect premises situate at the southeast
corner of Clarence Street and Maryland Avenue in the City of Saint Paul,
described as follows:
Starting at the intersection of the west line of the
east one-half of the IJ�J 1/1+ of the NW 1/�+ of Sec. 27,
T. 29, R. 22 and the north line of Sec. 27, T. 29,
R. 22; thence east 33 feet, thence south 33 feet to the
poi.nt of beginning, thence east �+�+.6 feet; thence
south 120 feet; thence west �+4.6 feet; thence north 120
feet to the point of beginning;
that a special permit hereby is granted to said applicant for the construction,
maintenance, and operation thereon of a drive-in refreshment stand with an
8-car capacity off-street parking facility accessory to said dxive-in
refreshment stand, in accordance with the final plans therefor hereby approved
and herewith filed, sub�ect to the requirements-hereby imposed on said applicant
and his successors in interest for the construction and maintenance of a retaining
wall of materials approved by the City Architect along the east property line of
said premises, for the construction and maintenance of a new public sidewalk
a.nd concrete curbing, under City permit, and in conformity with City specifications,
along the entire Clarence Street frontage of said premises, and for the restriction
of dsiveways therefrom connected t�rith Maxyland Avenue to egress to said premises,
and restriction of driveways connected with Clarence Street to directional uses
to be indicated by proper signs installed on said premises, and subject further
to compliance with the provisior�s of all applicable City ordinances and State
statutes arld rules and regulations of public authorities having cognizance.

the conditions set out in the Zoning Board letter as reflected in f inal

This is in the matter of the application of Milton M. Miller to establish
a drive-in refreshment stand with off-street parking accessory thereto
for 8 cars on� property located at the southeast corner of Glarence Street
and Maryland Avenue: The property is described as: starting at the inter-
section of the west line of the east one-half of the NW� of the NW� of
_ Sec. 27, T. 29, R. 22 and the north line of Section 27, T. 29, R. 22;
thence east 33 feet; thence south 33 feet to the point of beginning, thence
east 44.6 feet; thence south 120. feet; thence west 44.6 feet; thence north
120 feet to the point of beginning. The zoning of the subject property is ,
commercial. ' � , - '
The property is vacant and has a frontage of 44.6 feet on the' south side
of Maryland Avenue ancl 120 feet on the �east side of Clarence Street with
an area of approximately 5,352 square feet. The-Traffic Engineer and the
Planning Board staff have reviewed the proposal and recommend approval
subject to the construction of a retaining wa11 along' the east property
line because of the, clifference in grade of the adjoining property, and also
subject to the constfiuction of a new sidewalk and concrete curbing along
the Clarence Street frontage. It will also be necessary for the driveways
off Maryland Avenue to be limited to entrance only, and the driveways off
. Clarence Street to be limited to exiting with proper signs being installed
for directional use. �
The Board of Zoning considered this ma'tternat its_ regular meeting on
February 20, 1964, .and recommend the' granting of the permit as requested
subject to the recommendations as outlined above as reflected in final
plans dated March 18, 1964.
