MINUTES OF A LICENSE HEARING
National Multiple Scierosis Society, Minnesota Chapter located at Ron's Bar, 879 Rice Street
Tuesday, August 29, 2006, 3:00 p.m.

TY�e hearing was called to order at 3:03 p.m.
Staff Present: David Nelmark, License, Inspections and Environmental Protection (LIEP); and
Jean Birkholz, Council Research.
Others Present: Jon Heilig, National Multiple Sclerosis Society, Minnesota Chapter; Ron
Stotzheim, owner of Ron's Bar; and Crystal Graves, neighbor.
Application for a State of Minnesota Gambling Control Board's Premise Permit (Change in
Gambling Manager and Organization)
Ms. Moermond explained the process. This is a premise permit for gambling which automatically
triggers notification to the surrounding area because it's a class N license. Other licenses in the same
ciass include auto body repair, bar licenses, entertainment licenses, etc., things that neighbors generally
want to know about. Following that notification, an objection letter was received, which triggered this
hearing. There are three (3) possible outcomes from this hearing: 1) that she would recommend the
City Council grant this license without conditions; 2} that she would recommend the City Counci] grant
this license with agreed upon conditions; or 3) that she would recommend the City Council refer the
matter to an administrative law judge, which would be used if she felt there were conditions that were
necessary to make this a workable situation which the applicant would find unacceptable or if there is no
way this licensed activity can go here and have it be acceptable.
Mr. David Nelmark, license inspector with LIEP, provided a staff report. He stated that this is an
application for a change in organization and gambling manager at a bar that is already established
having pull tabs or lawful gambling. These are state licenses that they have applied far which require
City acknowledgement. The liquor license application contains a gambling endorsement, which they do
have. This is a change in organization. Minnesota Waterfall has been in there for about twelve (12)
years, and they have gone out of the gambling business. National Multiple Sclerosis Society, Minnesota
Chapter will be their replacement. They are already doing lawfiil gambling in the City of Saint Paul.
The Office of License, Inspections and Environmental Protection (LIEP) has reviewed this application
and has recommended approval with no conditions. Ms. Moerntond asked if there were conditions on
any of the other licenses held by Ron's Bar. Mr. Stotzheim responded that there were not.
Mr. Stotzheim explained that they are moving to a machine operated puil tab booth. Mr. Heilig,
representing the National Multiple Sclerosis Society, Minnesota Branch, explained that they are
proposing to put in a vending machine at Ron's Baz. Vending machines typically haue two (2) pull tab
games in them. If someone gets a winning ticket, he must take it to the bar staff to be redeemed.
Ms. Moermond noted that Ron's Baz has a pretty good history as far as police calls. They have been at
that location for 39 yeazs. Ms. Moermond asked if the bar was for sale. Mr. Stotzheim replied that the
bar is for sale, but he doubts that he will find a buyer since the City passed the smoking ban.
Ms. Crystal Graves addressed the hearing. She and her aunt wrote a letter of objection with concerns
aboui when people leave Ron's Bar. They live just around the corner and four (4) houses down from the

baz. In the last two (2) months alone, they have had two (2) people beat up in the street, and she Irnows
of at least four (4) more. They want the patrons of the baz to be safe and they want a safe, clean
neighborhood. Mr. Stotzheim responded that they have surveillance cameras on the whole parking lot,
inside the baz and upstairs. He noted that their cameras put the last guys in jail. Ms. Graves added that
they see many people leaving Ron's Bar who aze overly intoxicated, and several times she and her aunt
have escorted some home when they've collapsed in the street She noted that she and her aunt have
heazd people talking about robbing the people who come out of Ron's Bar, since there's gambling there.
Mr. Stotzheim stated that most of their customers aze working people or retired peopie from the
neighborhood. He added that the baz has not even been open past midnight in over a year, and when the
hall is rented, iYs only unril midnight.
Ms. Moermond asked how many staff peopie were employed. Mr. Stotzheim answered, "Just the
bartender." Mr. Stotzheim works only in the momings.
Ms. Moermond asked about the hours for renting the hall. Mr. Stotzheim responded that usually they
rent it from 4:00 p.m. or 6:00 p.m. and they must be out by midnight.
Mr. Moermond recommended approval without conditions.
The hearing was adjourned at 3:22 p.m.
