1 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of
2 noise in the City of Saint Paul; and
4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 constitute an unreasonable hazdship on the applicant, other persons or on the community; and

8 WHEREAS, Summit Brewing Company, represented by Steven Cerkvenik, Event Producer, who
9 has been designated as the responsible person on the application, has applied for a variance to present
10 live music at Harriet Island Regional Park; and
11
12 WHEREAS, applicant is seeking a variance far the hours of 10:00 a.m. to 10:00 p.m., on
13 September 30, 2006; and

WHEREAS, if applicant is not granted a variance it will not be able to present live music at
Hamet Island Regional Park; and
WF3EREAS, the Office of License, Inspections, and Environxnental Protection has reviewed the
application and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Summit
Brewing Company, subject to the following conditions:
1) The variance shall be for the hours of 10:00 a.m. to 10:00 p.m., on September 30, 2006.
2) All electronically powered equipment used in conjunction with the event shall not exceed 100
dBA, as measured at the closer of the sound mix or 100 feet from the front of the stage.

FURTHER RESOLVED, that any violarions of the conditions set forth above on the September
30, 2006 date may result in denial of future requests for the grant of a noise variance, in addition to any
criminal citation which might issue.
