WHEREAS, the Legislative Hearing Officer recommends that the license application for Liquor Outdoor
Service (Patio), extend the liquor service azea to the basement, and modify license condition #2 by G-8, Inc.,
doing business as Starting Gate Pub, located at 2516 Seventh Street West, be approved with the following
condition:
No entertainment shall be provided in the estabiishment unless the licensee has complied with the
provisions of the Saint Pau1 Zoning Code;
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license
application with the aforementioned condition.

RE: Legislative Hearing Officer Report on license application for G-8, Inc., doing business
as Starting Gate Pub, located at 2516 Seventh Street West
Patrick Scanlon, owner of Starting Gate Pub, applied for the following at 2516 Seventh Street
West: Liquor Outdoor Service (Patio), extend the liquor service area to the basement, and
modify license condition #2. License Condition #2 reads that "The licensee shall not use the
lower level (basement) for any purpose other than storage unless the licensee has complied
with the provision of the Saint Paul Zoning Code." I received one letter in objection to the
license application by the scheduled response date of July 7, 2006.
The letter was received from Roger Diestler, Sibley Manor Apartments, 1300 Maynard Drive
West. Mr. Diestler's only objection is that the proposed patio is in close proximity to Sibley
Manor Apartments. He requests that the business install a sound wall to prevent disturbance to
the tenants.
Racquel Naylor, Secretary, talked to Mr. Diestler a few weeks ago. He said that the Starting
Gate is putting up a wall to enclose the sound, and the owner of Sibley Manor Apartments is
satisfied with the situation. Mr. Diestler said that there does not need to be a hearing.
Because i was wondering if the wa1{ had been completed, Ms. Nay{or calfed Mr. Diestler last
week. He said that she should speak to Bob Julen, one of the owners. Ms. Naylor then spoke
to Mr. Julen, who said that the wall has been constructed, the owner of Starting Gate was very
cooperative, and there have been no complaints from the tenants of Sibley Manor Apartments.
This issue has been satisfactorily resolved; therefore, I am recommending that the City Council
approve the resolution to grant the licenses for the Starting Gate Pub on the following condition:
No entertainment shall be provided in the establishment unless the licensee has complied with
the provisions of the Saint Paul Zoning code.
