This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That Chapter 401 of the St. Paul Legislative Code be-and the same hereby is amended by striking the said Chapter 401 in its entirety and substituting in lieu and in place thereof the following: 401.01 "AUCTIONEER" DEFINED. For the purposes of this ordinance, any person who shall sell or offer to sell any property, real, personal or mixed, or any estate or interest therein in the City at auction, whether the same shall be exempt from duty or not, for his own gain or othetwiee, or shall advertise or in any, way hold himself out as a public auctioneer shall ba deemed to be an auctioneer. 401.02 LICENSES REQUIRED. on the business or occupation of of Saint Paul, as herein defined obtained a license therefor from Saint Paul. The application for the following: No person shall carry auctioneer in the City without having first the City Clerk of license shall include (1) Name of auctioneer and date of birth; (2) Business address; (3) Residence address; (4) Business address in the past five (5) years; and (5) Other business-activities, if any. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAM PAUL DOES ORDAIN: Section 1. No person shall administer, dispose, sell, barter, exchange or offer for sale, when he knows or can by reason- able diligence ascertain, that such administering, dispensing, selling, bartering, exchanging or offering for sale will provide the person to whom or for whose use such preparation is administered, dispensed, sold, bartered, exchanged or offered for sale, within 48 consecutive hours with more than six grains of codeine or any of its salts, except pursuant to a lawful prescription issued by a practitioner duly licensed under the laws of the State of Minne- sota. Section 2. No person shall within any 48 consecutive hours purchase or have in his possession more than six grains of codeine or any of its salts, except pursuant to a lawful prescrip- tion issued by a practitioner duly licensed under the laws of the State of Minnesota. Section 3. Any person violating the terms of this ordi- nance shall upon conviction therefor be punished by a fine of not more than $100 or imprisonment for not more than 90 days. Section 4. This ordinance shall be deemed a part of the City of Saint Paul Legislative Code and shall be incorporated there- in and given an appropriate chapter number and /or section number at the time of the next revision of said Legislative Code. Section 5. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. Section 6. This ordinance shall take effect and be in force upon its passage, approval and publication.
