License ID #19980005692 DeazSir/Madam: The O�ce of License Inspections and Environmental Protection has recommended adverse action against the Cigarette/Tobacco License held by Txnan Akli, d/b/a Rice Street Market for tl�e premises located at 1200 Rice Sireet in Saint Paul. The basis for the recommendation is as follows: On June 20, 2006, a tobacco compliance check was conducted at the Rice Street Market for the premises located at 1200 Rice Street in Saint Paul. A fifteen year old male entered the store and asked to bny cigarettes. He was asked to show his identification, and did so. Tt correctly stated his date of biu-th, which indicated he was uuderage. Nevertheless, tke cterk aIlowed him to pnrchase tke package of Marlboro Lights cigarettes. • Sale of tobacco to an underage person is a violation of Minn. Stat. §609.85 and Saint Paui Legislative Code §324.07. Since this counts as a first violation for the sale of cigarettes fo an underage person, the Iicensing office kas recommended a $200.00 fine. If tlus is your choice, you should make payment directly to the Office of License, Inspections and Bnvironmental Protecfion, at 8 Fourth Street East, Suite 200, St. Paul, Minuesota 55101-1002 no later than Tuesday, July 25, 2006. Information should be directed to the attention of Christine Rozek. A self-addressed envelope is enclosed for your convanience. Payment of the fine will be considered to be a waiver of the hearing to which you are entztied. 2. If wish to have a public hearing before the Saint Paul City Council, you wiil need to send me a letter with a statement admitting the facts and requesring a public hearing. We will need to receive your letter by Tuesday, July 25, 2006. The matter will then be scheduled before the City Council for a public hearing to deter�niue whether to irupose the fine. You will have an opporhznity to appear before the Cotzncil and make a statemettt on your own behalf. 3. If you dispute the above facts, qou can request a hearing before an Adtuiiustrative Law Judge. At fhaf hearing both you and the City will be able to appeaz and present witnesses, evidence and cross-exaxnine the other's witnesses. The St. Pau1 City Council will ultimately decide the case. If this is your choice, please advise me by Tuesday, July 25, 2006, and I will take the necessary steps to schedule the administrative hearing. If I ltave not heard from you by that date, I will assume that you do not contest the imposition of the fine. Please be advised that the clerk who was identified as having made tha sale on tbis date is also being charged an administrative penalty pursuant to Minn. Stat. §461.12, subd. 3.
