RESOLVED, that, with the accompanying Utility Easement Certificates of Intended Non-
Use, filed voluntarily on behalf o£ District Energy/District Cooling St. Paul, a private,
non-profit Minnesota corporation; Comcast, a Pennsylvania corporation; St. Paul
Regional Water Services, a municipal corporation; Qwest, a Colorado corporation;
The City of Saint Paul Public Works, a municipality; made a part hereof by this
reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and on
behalf of these corporations and departments, waives the right to the street right of way and
utility easements in the area to be vacated, described above and subject to the following:
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended, and to the following conditions:
That the petitioners, their successors and assigns shall pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
That the petitioner, their successars and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
properiy, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regularion made in accordance with the law, whether by the
petitioners or any of their agents or employees.
That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with the City Clerk an acceptance in writing of the conditions of this
resolution and shall, within the period(s) specified in the terms and condifions of this

The City Clerk has refened to this office for recommendation the petition of Rick Lesch for the
vacarion that part of Germain Street lying north of the north line of Christie Place and south of a
line 43.00 feet south of and pazallel with north line of the Northeast Quarter of Section 22,
Township 29 North, Range 22 West of the Fourth Principal Meridian.
As indicated, this inquiry pertains to the vacation of City right-of-way only; utility easements may
remain in place even if street usage is removed.
The purpose of this vacation is to a11ow for development of single family residences west of
Germain Street.
Will you please advise me of any concerns you may have regarding this proposed vacation as
soon as uossible. I would like to receive your comments before July 7, 2006 so I can prepare a
report to the City Council on this matter. If you would rather respond on your letterhead, please

the City Clerk of Saint Paul, Minnesota, as will be heazd and considered by the Saint Paul City
Council at a meeting to be held in the Council Chambers on the 3rd floor of City Hall and Court
House on the 16th day of August, 2006 at 530 P.M.

RE: Public Works Vacation File No. 09-2006 (Vacate Germain Street between
Larpenteur Avenue and Chrisfie Place)
I recommend a public hearing before the City Council be held on August 16, 2006 to
consider the petition of the Rick Lesch, acting as developer, to vacate unimproved Germain
Street between Laspenteur Avenue and Christie Place.
The purpose of this vacation is to facilitate the construction of single family residences.
This property is located in City Council District 6, Planning District 2.

Quit Claim Deed to vacate the right-of-way of Germain
Street which adjoins e�property with provision that Rick
