PAUL OFFICE OF THE CITY CLERK COUNCIL RESOLUTION - GENERAL FORM PRESENTED BY COMMISSIONER— _" COUNCIL NO "06 FILE WHEREAS, in the matter of the construction of the STORM AND CLEAR WATER SEWER in Sixth Street from St. Peter Street, thence east 222 feet, Comptroller's Contract L -6650, Axel Newman Heating and Plumbing Company, contractor, designed to serve the new Wabasha Court Building.,-located on the northwest corner of Sixth and Wabasha Streets, the specified date of completion is July 1, 1964, and WHEIEAS, the previsioned completion date made a part of the Special Provisions of said project on the basis of information sufficient to form a belief by the design engineer that the new Wabasha Court Structure would be in need of such sewer service at that time, and WHEEE AS, it became apparent later that the necessity of completing the work by said expiration date was not urgent and that an exten- sion of time to:a later date would result in no hardship-to the parties in interest, now therefore, be it RESOLVED, That the proper City Officers be and they are hereby authorized and directed to execute an amendment to said-contract extending the time for completion to SEPTEMBER 4. 1964, provided however, that this resolution shall have no force or effect unless the sureties on the contractor's bond consent thereto in writing and file such consent with the City Comptroller, and be it - FURTHER RESOLVED, That the City of St. Paul hereby waives all claim for liquidated damages and that no engineering and inspe ct#n costs on this project will be charged to the contractor on account of such extended period. ri COUNCILMEN Yeas Nays - Dalglish Holland Loss *Aered th Peterson Rosen Mr. President, Vavoulis font 6-62 SAP 1� Adopted by the Council 19— SEP 18 04 Approved 19— To Favor � Mayor Against DUPL&AT[ TO PRINTER CITY OF ST.
