3 WHEREAS, adverse action was taken against the Sidewalk Contractor license held by Jerry
4 Tavernier, LLC d/b/a Tavernier Concrete (License ID #20050002681) for the City of Saint Paul, by Notice
5 of Intent to Suspend License dated July 12, 2006, alleging licensee did not submit a required
6 Sidewalk/Bituminous bond in the amount of $5,000 for the period of October 6, 2005 through June 21,
7 2006; and
9 WI3EREAS, the licensee did respond to the Notice of Intent to Suspend License to contest the
10 allegation or to submit required bond information; and
11
12 WFIEREAS, the Norice of Intent to Suspend License stated that if the licensee failed to contest the
13 allegation or submit the required bond information by July 24, 2006, that the matter would be placed on the
14 consent agenda to impose the recommended penalty; now, therefore, be it
15
16 RESOLVED, that the Sidewalk Contractor license held by Jerry Tavernier, LLC d/b/a Tavernier
17 Concrete is hereby suspended.

The Office of License, Inspections and Environmental Protection has recommended
suspension of the Sidewalk Contractor license held by 7erry Travernier LLC, dlb/a Travernier
Concrete for the City of Saint Paul. The basis for the recommendation is as follows:
On January 17, 2006, you were sent a letter from the Office of License,
Inspections and Environmental Protection stating that your license had been
placed "on hold" until you submitted a Sidewalk/Bituminous bond in the
amount of $5,000 for the period of October 6, 2005 through June 21, 2006.
You were given until January 30, 2006 to submit the requested information.
As of today's date it has not been received.
At this time, you have three options on how to proceed:
If you wish to continue to do business in the City of Saint Paul, you can submit the
necessary information to the Office of License, Lnspections attd Environmental
Protection at 8 Fourth Streef East, Suite 200, St. Paul, Minnesota 55101-1002 no later
than Monday, July 24, 2006. Information should be directed to the attention of
Christine Rozek.

2. If you wish to have a public heatiug befare the Saint Paul City Council, you will need to
send me a letter with a statement admitting the facts and requestiug a public hearing. We
will need to receive your lettez by Monday, Jnly 24, 2006. The matter will then be
scheduled before the City Council for a public hearing to determine whether to suspend
your license. You will have an opporiunity to appear be£ore the Council and make a
stafement on your own behalf.
3. If you no longer wish to do business in the City of Saint Paul, you may send a written
statement to that effect to the Office of License, Inspections and Environxnental
Proteciion, 8 Fourth Street East, Suite 200, St. Paul, Minnesota 55101-1002 no later than
Monday, July 24, 2006. Information should be dixected to the attention of Christine
Rozek.
If you have not contaeted me by that date, I will assume that you do not contest the
suspension of your license.
