1 WF�,REAS, the Saint Paul City Council adopted Council File #OS-669 on August 3, 2005 an Order to
2 Remove or Repair the buildings at 332 Saint Clair Avenue within 30 days; and

a WHEREAS, City staff, including the Legislative Heazing Officer met with the owner of the property, Aurelia
s Tessmer, on numerous occasions in order to facilitate the removal of this public nuisance through the
6 rehabilitation of the structure by a contractor selected by her and approved by the City, or a new owner
� competent of completing this rehabilitation; and

9 WHEREAS, the building has not been sold to a competent rehabber, and no contractor has been selected or
lo approved;

i2 WHEREAS, plans for the building's rehabilitation which address all of the deficiencies outlined in the Code
� 3 Compliance Inspection report have not been developed, and no financial information demonslrating the
t4 owner's ability to complete this project have been developed or approved;

16 WFIEREAS, the code compliance inspection report of has been completed on June 2, 2005 and a performance
17 deposit was received and subsequently forfeited for lack of progress on Mazch 29, 2006; and

t9 WHEREAS, the property at 332 Saint Clair Avenue is zoned R-Dup]ex with a nonconforming lot because of
20 its location near the bluff overlooking the Mississippi;

z2 WHEREAS, given cunent setback resirictions, both from other property lines and the bluff; this would not be
z3 considered a"build-able parcel," and therefore, ifthe properry were demolished, no housing could be built at
z4 the location to replace the 2 units in the vacant structure; and

26 WHEREAS, it is the determination of the Legislative Heazing Officer that it is unlikely this buitding will be
2� rehabilitated under its current ownership; now, therefore be it

29 RESOLVED, that the City Council hereby grants a stay in the implementarion of Council File #OS-669
3o indefinitely and under the following conditions:

32 1) Any future application for building permiYS must be accompanied by
33 a. a performance deposit as described in Legislative Code Chapter 33.03( fl;
34 b. A work plan which addresses the scope of the corrections required in the code compliance
35 inspection report dated June 5, 2005; and
36 c. A fmancial plan which demonstrates the owner has the financial where-with-all m complete the
37 rehabilitation project;
38 2) The owner, Aurelia Tessmer, must notify the City in writing of any ownership change;
39 3) The Deparhnent of Neighborhood Housing and Property Improvement may pursue removal of the
ao building if conditions by providing 1 week's advance written notice to the owner at her last known
41 address and obtaining a Council resolurion lifting the stay herein enacted, or, if conditions warrant, the
42 deparknent may pursue emergency abatement procedures per the legislafive code; and
43 4) Any future owner is bound by the condirions established by this resolurion until such time as the property
4a no longer constitutes a public nuisance, by virlue of its rehabilitation or removal.

create a non-profit corporation to mazket and promote the city as a tourist and/or
convention center.
14. Resolurion - OS-708 - Approving the execution of an agreement combining the functions
and responsibilities of the RiverCentre Authority and the Saint Paul Convention and
Visitors Bureau by creating the RiverCentre Convention and Visitors Authority, a
non-profit corporation.
Items 13 and 14 were discussed together. Councilmember Helgen expressed his gratitude
to staff in their efforts to create this new boazd. Councilmember Helgen
moved approval.

Mazcia Moermond, Legislative Heazing Officer, stated of the three items listed, only the
back taxes have been paid. No work plan has been submitted nor has a financial pian
been submitted. Four weeks have lapsed between the Legislative Hearing and today's
meering. Because the conditions have not been met for this dangerous structure, Ms.
Moermond recommended that the order to remove or repair the buiiding be adopted with
a time frame of 30 days. This shucture may be able to be rehabilitated if the property's
ownership is transferred.
Councilmember Thune moved approval of this resolution with a 30-day remove or repair
amendment.

Sandbezg responded that the TISH Board adopted a policy wlrich is a disciplinary matriac
and wlvch they used to apply in this case. Council President Lantry asked that an
electronic version of what was used to detennine the 30-day suspension be sent to all
Councilmembers.

53. Resolurion - OS-668 - Ordering the owner to remove or repair the building(s)
at 1002 Marilda Street within fdteen (15) days from adoption of resolution. (Legislative
Hearing Officer recommends granting the owner 180 days to complete the rehabilitation
of the property provided the following is completed by noon on July 20, 2005: 1) a code
compliance inspection report; 2) a$2,000 bond is posted; 3} a work plan is submitted
indicating how and when all the items on the Code Compliance Inspection Report will be
addressed; and 4) a financialplan is submitted indicating the wherewithal to complete the
wark on the Code Compliance Inspection Report.)
Trudy Moloney, Director of City Council Operations, reported that the Legislative
Hearing Officer, Mazcia Moermond, was out of town on business. Ms. Moermond
reviewed her cases with Ms. Moloney for her to report on. In this case, Ms, Moermond
recommended continuing the public hearing for two weeks in order to receive an
engineering report which the property owner has scheduled. The property owner has a
code compliance mspection, has posted the $2,000 bond, but will not complete the work
plan or financial plan until an engineering report comes forwazd.
No one appeared in opposition.
Councilmember Helgen moved to amend the Legislarive Hearing Officer's
recommendation by granting the owner 60 days to complete rehabilitation provided a
bond inthe total amount of $S,OOQ is posted by August 3. A progress report is to be
provided to the Council in 30 days.
Councilmember Helgen moved to confinue the public hearing to August 3.

general time period when things will be done and the subcontractor name(s); 3) a financial
plan is submitted showing the wherewithal to complete the work on the Code Compliance
Inspecrion Report; 4) the vacant builduag fees aze paid; and 5) the purchase agreement is
completed)
Trudy Moloney, Duector of City Council Operations, presented a report on behaff of
Mazcia Moermond, Legislative Heazing Officer. She stated that the Legislative Hearing
Officer recommended removing or repairing the property within fi$een days because all of
the sripulations have not been met. A$2,000 performance bond was posted but not the
$5,000 which was requested. A work plan or financial plan have not been received. The
2�05 vacant building fees of $25Q.�0 have not 6een paid. There is a purchase agreement
but Ms. Moloney said they were unsure if it was the most up-to-date one for the property.
Jim Clobes appeared and said he purchased the property two days prior to this meefing, he
posted bond, and paid all back taxes. Anything that couldn't be paid they have in escrow
because the City will not accept it until the fmal numbers are taken care of. Mr. Clobes
said "they" have agreed to all of the recommended code compliances by the City
Inspector. He indicated he had up-to-date contracts, forms and warranty deeds. He said
the city planner only requested a$2,000 bond.
Steve Magner, Department of Neighborhood Housiag and Property Improvement (NHI),
stated he was present at the Legislative Hearing on this properry. Based on the problems
with this property and the discussions revolving around it, it was his opinion that the
Heuing Officer felt the noxmal $2,000 bond required by ordinance needed to be inczeased
to guarantee that this property was rehabilitated in a timely fashion. That was made clear
to two gentlemen who represented themselves as the buyers of this property. They
did not have a purchase agreement at the Legislarive Hearing and that is the reason one of
the stipulations was to produce that document to show that they had actually closed on
the property or had interest in it by the time of the public hearmg on this date. The
request for a$5,000 bond was made clear to Mr. Phillip Weiss and Mr. Weinhold who
indicated he was the purchaser. That information was not given to the Office of LIEP as
NHI generally waits until a decision is made at the public hearing on the formal bond cost
before no6fymg them. What generally happens is that a person will voluntarily submit the
funds and LIEP will accept that or they will come back after the public hearing and pay
the full amount in a timely fashion. Mr. Magner said he did not think the City acted
inappropriately by accepting only the $2,000 but it was unclear to him who has been

ORDER
The Saint Paul City Council hereby makes the following order:
l. T'he above referenced interested or responsible parties shall make the Subject Property safe and
not dehimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitaring this structure and correcting ali deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building{s) in accozdance with all appIicable
codes and ordinances, or in the altemarive by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the stracture must be completed within�t�u�(33}days after the date of the Council

2. If the above corrective action is not campleted within this period of time I3eighborhood Housing
& Property Improvement is hereby authorized to take whatever steps are necessary to demolish
and remove this strucmre, fill the site and charge the wsts incurred against the Subject Property
pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event ihe buiiding is to be demolishad and removed by the City of Saint Paul, all personal
properry or �etures of any kind which interfere with the demalition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resoIution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul i,egislative Code.

Steve Magner gave a staff report: The buiiding was condemned on 10-12-04 by NHPI and has
been vacant since 10-25-04. 'Fhe caaent owner is Walter G. Tessmer. There haue been no
summary abatement notices issued. On 4-27A5, an inspecfion of the building was conducfed, a
Iist of deficiencies which constitute a nuisance condiiion was developed, and photographs were
taken. An Order to Abate a Nuisance Building was issued on 5-4-OS with a complianoe date of
6-3-05. As of tFns date, this properly r�*�+a�ns in a condition which comprises a nuisance as
defined by the legisIative code. Tiie vacant buiiding fees were paid by Aure&a Tessmer on 5-26-
O5. Real esta#e t�es are unpaid in the amount of $2,158.8�. Taxation has placed an estiinated
market value of $31,500 oa the 2and and $ I24,900 on the building. On 6-2-05, LIEP completed
a Code Compiiance Inspection report. On 6-29-05, a$2,000 bond has been posted with LIEP.
Code Enforcement Officers esfimated the cost to repair is $80,000 to $90,000. The estimaYed
cost to demoIish is $7,000 to $8,Q00.
Ms. Moermond asked Ms. Tessmer who is Walter Tessmer (listed as fee owner) in relafionship
to hex. Ms. Tessmer responded her dad. Tbis was taken to probate and should have been
completed. She will have to ekeck into this. She has three contractors ready to repair it. Ske is
bonowing money to finance this.
Tn answer to a question about taxes, Ivis. Tessmer responded she paid the ciurent half: She is not
awaze of previous ta�res.
Ms. Moermond recommends granting the owner 180 days to complete fihe rehabilitation on the
property on condition tkat the following is done by noon of July 20, 2005: 1) a work glan
submitted indicating how and when all the items on the Code Compliance Inspection Report will
be completed, 2) a financial plan which demonstrates the capaciTy to pay the contractors for tlie
work to be done, 3) taz�es broughY and up to date. If the properiy is being sold, she would like to
see a purchase agreement.

l��ei�hborhood Haasin� & Property Imgrovement has declazed this bailding(s) to constitute a
"nuisance" as defined by Le� s2ative Code, Chapter 45. Nei�hborhood Honsin� & Property
Improvemeni has issaed an order to the then known responsible parties to eliminate this nuisance
condiTion by correcring the deficiencies or by razin� and removin� tfiis builciin�{s)_
Inasmuch as this Order to Abate has noi been complied with the naisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Neighborhood Housing & Property Improvement that the City Council
pass a resolution ordering the responsible parties to either repair, or demolish and remove this
buildinD in a timely manner, and failing that, authorize the Neighbarhood Housina & Property
Improvement to procezd to�demolirion and removal, and to assess the costs incurred against the
real estate as a speciat assessment to be coltected in the same manner as ta;ces.
