Appeal of James Straub to a Norice of Registered Vacant Buiiding Fee for property at 801 Juno Avenue. (NHPI) � Ms. Moermond stated she had talked with the Building Inspector, Jim Seeger, regarding the Code Compliance Inspection report and they both determined there were too many li£e-safety hazards that needed to repaired before the building could be occupied. Therefore, she recommended denying the appeal and waiving the Registered Vacant Building Fee for 180 days. 4. Update on 431 Page Street East. (NIIPI) Lisa Her-Bauer, property manager representing the owner, stated she needed additional time to complete the repairs from the August 1, 2006 extension that was previously granted by the Council. They had suffered a delay in getting the foundation done as they had anticipated it would only take four weeks when it actually took eight weeks to complete. The inspector came out to fanal the plumbing permit and ordered additional work needed to be done on the vent to the bathroom fan. Mr. Seeger then came out for a final inspection and ordered they remove a wood burning stove in the basement or cement it in to seal. There was also an issue with drainage problems azound the garage and they were instructed to replace the flashing and she was still waiting for the contractor to come out and make this repair. They also needed to install the flooring on the first floor. Ms. Moermond recommended granting an extension to complete the work to September 1, 2006. 5. Appeal of Kevin Boldt to a Notice of Certificate of Occupancy Revocation for property at ll 84 Arcade Street, A t�. 1. (Fire Prevention) Ms. Moermond recommended lying this matter over to August 1 Legislative Hearing and the August 2 City Council Public Hearing. 6. Appeal of Patrick Speltz for a Summary Abatement Order for property at 741 Mount Curve Boulevard. (NHPI) Mr. Magner stated he received a call that the electricity had been turned off for non-payment. He had met with the owner on July 11, 2006 and issued orders to remove two doors, rubble and miscellaneous debris. There was also a large dirt pile which was a violation and the sidewalk was broken. Since the electricity had been turned off, the building was condemned. Mr. Speltz stated he had contacted Xcel Energy to let them know he had closed his bank account and that he would send in a new check. They cashed the check anyway and it bounced. He was undertaking a very large remodeling of the property and had hired Joe Palen as his general contractor. He was also approved for a$90,000 loan to do the remodel. He requested additional time to remove all of the debris as Palen was going to take out two foundation walls in the basement and they would remove all of the debris in the yard at that rime. Resolution ordering the owner to remove or repair the buildings(s) at 432 Paee Street East If the owaer fails to comply with the resoIutiou, Neighborhood Housing and Property Improvement is ordered to remove the bwlding(s). Daniel Douglas and Lisa Herbauer, appeared Steve Magner provided a staff report: 431 Page Street East is a 2-story, wood frame, single-family dwetling on a lot of approximately 4,780 square feet. According to their files, the building was condemned on Mazch 23, 2005 and ordered vacated. A new property owner took possession on December 19, 2005: Daniel Douglas (with mailings going to Ms. FIerbauer). There has been at least one (1} Sutmnary Abatement issued to ciean-up gasbage, scrap vehicle parts, scrap wood, rubbish and improperly stored items. On November 2, 2d05, an inspection of tlte building was conducted and a list of deficiencies which constitute a nuisance condition was developed, and photographs ware taken. An Order to Abate Nuisance Building was posted on November 7, 2005 with a compliance date of December 7, 2005. As of today, the property remains in a condifion which comprises a nuisance as defined by the Legislarive Code. The Ciry boarded the building to secure it against trespass. The Vacant Building fees have not been paad. Tasation places an estimated market value of $39,200 on the laad and $121,200 on the building. A Code Comgliance Inspection was completed on June 5, 2005, by the prior owners and is attached. As of today's date, a bond has not been posted nor have pemuts been pulle3 for work which needs to be done. The City esrimates repairs to be between $60,000 and $70,000; demaliflon between $8,000 and $9,000. The department has had brief conversarions with Yhe new owners and it is Mr. Magner's understanding that they were made awaze of this Order to Abate, and it was their plan to post a bond and start rehabilitation. Ms. Moermond asked when the Summaiy Abatement and boarding occiured. Mr. Magner answered that they occurred fluring the previous ownership in 7une and 3uly of 2005. Mr. Magner went on to explain #hat tius was a case where the original owner (Gladys A. Schwanner) died. She left the properiy to six (6} sihlings, some of whom were residing at the property. iJltimately, the siblings decided to sell the property. Mr. Magner noted that the NHPI generaIly does not mail out Code Compliance Iaspection Reports; it's not their document. F3e recommended that the new owners go to the Office of License, Iuspection and Bnvironmental Frotection (LIEP}, 8 Fo�sth Street Fast, and ask foz a copy of t�e Code Compliance Insgeet4on Report for this properiy. He added that tlie seller should have provided a copy; it was their Iegal obligation. Ms. Moermond asked that a copy be provided far them before they leave the hearing. Ms. Herbauer asked about the City rec}uiring a bottd to secure the fact that they would be doing the rehab. Ms. Moermond replied that a bond is required for every single dangerous structure. Right now, a$2,fl00 bond is required; when the Ordinance changes in approximately thirty (30) days, a$5,000 bond wifl be rec�uired. This is a performance deposit that is retumable upon completion of the project if it is done in the time allotted. The City Council will grant up to 180 days for completion. Ms. Herbauer noted that there aze other investors who might be interested in taldng over the property Yo rehab it. If that doesn't happen, Ms. Herbauer and Mr. Daniels will rehab the praperty themselves. Ms. Herbauer has estimated the materials to cost approximately $16,000 to bring everything up to Code. Ms. Moermond noted that the Code Compliance Inspection Report replaces the Truth in Housing Inspection Report, and there may be more items on it. She added that she needs to know that the new owners understand the scope of the rehab. Ms. lYloezmand would like to see a Work Plan (contractors, bids, work schedule, etc.} and a Financiai Plan, The new owners need Yo post a$2,000 bond (rehunable upon completion of the rehab.} If there is a question of finance, many snnaIl operators choose to save some aspects of the project like carpering, for example, to do after they receive back the boad money. Legislative Hearing Officer recommends granting the owner an additional 180 days to complete the rehabilitatian of the property on condition that a$2,000 bond is posted amd both a Work Plan and a Financial Plan are submitted to her and approved no later than the close of business on Friday, Januazy 13, 2006.
