WHEREAS, The Ashbadh Construction Company has a contract wiic',`aTn'`" " "
the Minnesota Highway Department and has subcontracted to Gangl Excavating
Company for excavation and hauling of material to be loaded near East
Seventh Street between Broadway and John Streets and hauled to an area
between the east end'of the new East Sixth Street Bridge and the new
Mounds Boulevard Bridge for Interstate #94 roadway; said subcontractor
desiring to do such hauling utilizing 15 cubic yard rubber tired turnapull
scrapers and to haul over the following route: John Street between
East Fourth and East Fifth Street's,_ and then East Fourth Street from
John Street easterly to the vicinity of Hoffman; therefore, be it
RESOLVED, That the Ashbach Construction Company be given permission
to use the above streets as a haul road for scrapers, subject to the
following conditions for the protection of City- iiwned property, viz:
s 1. The City be supplied registered survey information acceptable
to City in the form of field notes or profile drawings
of present curb, gutter and street center line elevations
at distances not exceeding fifty (50) feet for the above
haul route streets as taken by a Registered•P;bfe.sslonal
Engineer or Land Surveyor before beginning of hauling
operations.
2. Permittee will notify City before actual hauling begins
and will complete all hauling on this route by September,309
1964.
FOR PRO ED 3. Permittee agrees in writing to replace or rebuild any
curbing, pavement, manholes, catch basins, etc. damaged
by his operations at the direction of and to extent directed
Asst. Corp abon Counsel by the Chief Engineer.
4. Should actual- scraper operation reveal that the streets
are receiving more excessive damage than anticipated,
all such hauling shall be immediately discontinued upon
written notice to the contractor from the Chief Engineer.

settled, broken out or otherwise rendered hazardous or
unusable as a public street in the opinion of said Chief
Engineer, the permittee shall resurface such streets with a
minimum two inch asphaltic concrete overlay in accordance with
City Specifications and to the extent directed by the Chief
Engineer. 1
6. The contractor shall provide bond and insurance protection
meeting the approval of the Corporation Counsel of the
_ -, City of St. Paul and indemnifying the City against all
manner of claims resulting from said contractor's operations.
7. To insure full and prompt compliance with these requirements,
the contractor shall post a $10,000.00 bond with the City
of St. Paul, said bond not to be released until approved
by the Chief Engineer*i
