BE IT RESOLVED, that, upon the petition of the City of Saint Paul, as documented in Public Works
Technical Services, Vacation File Number 06-2006, the public property hereinafter described is hereby
vacated of its interest as a11ey right-of-way:
The east-west alley as dedicated on the plat of Braatz Place, Saint Paul Minnestoa.

This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
Saint Paui Legislative Code as amended, and to the following conditions:
RESOLVED, that, subject to the herein stated exceptions and with the accompanying Utility Easement
Certificates of Intended Non-Use, filed voluntarily on behalf of: District Energy/District Cooling St.
Paul, a private, non-profit Minnesota corporation; Comcast, a Pennsylvania corporation;
Northern States Power Company dba Xcel Energy (Gas), a Minnesota corporation; St. Paul
Regional Water Services, a municipal corporation; Qwest, a Colorado corporation; The City of
Saint Paul Public Works, a municipality; made a part hereof by this reference and filed in the office of
the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations and deparhnents,
waives the right to the a11ey right of way and utility easements in the area to be vacated, described above
and subject to the following:
1. That the petitioners, their successors and assigns shall pay $600.00 as an admuv strative fee for
this vacation which is due and payable within 60 days of the effective date of ttus resolution.
2. That an easement shall be retained on behalf of Qwest for an existing aerial cable in the described
vacation, which Qwest would be willing to relocate, if needed, at the petitioner's expense.
That an easement shall be retained in favor of Northern States Power Company (N5P), Minnesota
corporation dba Xcel Energy (Electric) over, under and across the north 10 feet of the east-west
a11ey as dedicated on the plat of Braatz Place, Saint Paul, Minnesota. Additionally, NSP retains a
utility easement over, under and across that part of the above-described a11ey over which aze
located a transformer and related overhead distribution facilities, as shown on map of recard with
Vacation File 06-2006.
4. The City of Saint Paul Public Works has the following provisions:
a) The petitioner and tl�e other abutting properiy owner, andfor their successors and
assigns shall execute parking, access and maintenance easement agreements covering the

b) The getitioner, andfor their successors and assigns, shall get approval from the City, via
a plan approved by the Aepartment of LIEP, for any chauges they aze proposing within the
vacated area, including, but not limited to, a fence or gate.
c) Gates, if installed, shall be set back enough so waiting vekricles will not block the
public sidewalk.
That the pefitioner, their successors and assigns agree to indemnify, defend and save harmless the City of
Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a result
of injuries or damages received or sustained by any person, persons or properiy on account of this
vacation,or the petitioners' use of this property, includmg but not lunited to, a claim brought because of
any act of omission, neglect, or misconduct of said petitioners or because of any claims or liability arising
from any violation of any law or zegulation made in accordance with the law, whether by the petitioners
or any of their agents or employees.
Tl�at the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall,
within the period(s) specified in the terms and conditions of this resolution, comply in all respects with
these terms and conditions.

The City Clerk has referred to this office for recommendation the petition of Cleo Kelly for the
vacation of the East-West Alley beiween Arcade and Sinnen Streets, further described as between
Margaret Place, Lots 1-6, and Braatz Place, Lot 1. As indicated, this inquiry pertains to the
vacation of City right-of-way only, utility easements may remain in place even if alley usage is
removed.
The purpose of this vacation is to limit traffic to those two property owners whose property abuts
the alley, since changed traffic patterns have contributed to this alley becoming a traffic shortcut.
Properry on the a11ey has also been plagued with gz�ti, therefore petitioner would like to fence
the alley at both ends. There will be no building on the site.
Will you please advise me of any concerns you may have regazding this proposed vacation as
soon as nossible. I would like to receive your comments before June 15, 2006 so I can prepaze a
report to the City Council on this matter. If you would rather respond on your letterhead, please
refer to the above listed file nuxnber when replying. For your convenience, you will find an
inquiry reply form and Certificate of Intended Non-Use enclosed with this correspondence. For
the vacation of right-of-way only, you may fax or e-mail your reply to us.

north 10 fset of the East-West alley between Arcade and Sinnen Streets, further

Additionally, utility easement in favor of Northern States Power Company, a

LIEP has no objections to the proposed alley vacation subject to the following condition/comment
Looking at the aeria! photo, it appears that there are parking spaces on the south side of the aliey and that
these space need the alley for access from the street. I am pretty sure these spaces must remain to meet
the zoning requirement for parking for the businesses to the north of the alley. So if the alley is vacated,
access to these spaces must be maintained. If barriers are put up at the ends of the alley to stop thru
traffic, they cannot be fuced barziers. They would have to be gates tfiat couid be opened. 1 think that
Public Works will want these gates set in at least a car length (18') from the public sidewalk to cars can
stop to open the gate without biocking the sidewalk.
