RESOLVED, Upon due consideration of the pertinent Appeal,
under the Zoning Code, by James L. Sexton, owner of the subject
read estate, situate-in the City of Saint Paul at and adjacent
to the southwest corner of Ramsey Street and Western Avenue,
zoned in "C ".Residence District, under said Zoning Code, and des-
cribed as follows:
"Except southerly 145 feet, westerly 49 feet of Lot 3
and except southerly 145 feet, the easterly 11 feet
of Lot 3 and all that part of Lots 1 and 2 northerly
of southerly line of above described part of Lot 3,
produced to easterly line of said Lot 1, Block 12,
Terrace Park Addition to the City of St. Paul, Ramsey
County, State of Minnesota;"
that the provisions of said Zoning Code hereby are determined and
varied, in respect of their application to said real estate, as
and to the extent necessary therefor and that the building set
back line applicable to said real estate in relation to the west
line of 'Western Avenue upon which the said real estate abuts,;:,
hereby is established as a line drawn north and south across
said real estate, parallel to said west line of Western Avenue
and eight (8) feet distant from said west line of said Western
Avenue; and that upon due consideration of the pertinent applica-
tion by said James L. Sexton therefor, the said James L. Sexton,
as owner of said real estate, hereby is granted a special permit
for the.installation, maintenance and operation, on said premises,
of a 24 -car capacity off-street parking facility in accordance
with the final plans therefor dated July 15, 1964, hereby approved
and herewith filed, such off - street parking facility ,to_Z be
maintained and operated in conjunction with a proposed 22 -unit
apartment building to be constructed on said premises; and
RESOLVED FURTHER, that said James L. Sexton and his
successors in interest, in respect to said real estate, otherwise,
shall make due compliance with all applicable ordinances,statutes,
and rules and regulations of public authorities having cognizance.

The site which is vacant and shaped irregularly, has a frontage of 127 feet
along the west side of unimproved Western Avenue and extends to an average
r depth of 238 feet, resulting in an area of approximately 24,722 square feet.
It is proposed -to develop.it with a 22 unit apartment building with off -
street parking for 24 cars accessory thereto. The City Architect's office
advised tbe'applicant it would be 'necessary to secure Council approval in
order to locate the proposed building at the closest point within 8 feet
of Western Avenue.
The Board of Zoning considered this matter at its regular meeting on
June 4, 1964. The staff advised that the r_e_quested.__8 foot buildirrT f ine
setback from unimproved — Western Avenue weas reasonable, and that the appli-
cant's parking lot plan met the required standards and had been reviewed
and approved by the Traffic Engineer. -The proposal meets the ,required
standards for density and building ground coverage. In consideration lof
these factors, the Board of Zoning recommends the granting of the app ;al
and application for permit as above outlined on the above desc_Ujed Aro-
perty in accordance with final plans dated July 15, 1964.
