RESOLVED, That upon recommendation and report of the Assistant
Valuation and Assessment Engineer, the sum of $1,629.95 be
refunded to the R & W Realty Company, subject to the approval
of the Corporation Counsel, said amount representing excess of
escrow deposit made covering the assessments for the improvements
of streets, sewers, water mains, sidewalks and curbing over the
amount actually required to pay the cost of said improvements,
abutting Lots 18, 22, and 24, in Block l; and Lots 2, 3, 8, and 9
in Block 2, South Battle Creek Heights.

Gentlemen:
On October Q7, 1964, assessments for the curbing and grading
of Nelson Street were levied against properties in Blocks 1
and 22 South Battle Creek Heights.
These levies complete the improvements for which escrow pay-
ments wereldeposited by the R & W Realty Company as required
by the contract agreements between the City and said company.
Deposits were made for Lots 18, 22, and 24, in Block 1; and
Lots 2, 3,�8, and 9, in Block 2 to cover the costs of street
grading, sewer, water mains, sidewalks and curbing. The side-
walks werelconstructed under private permit, and the remainder
of the improvements were constructed under normal city improve-
ment procedures.

There remains a balance of $232.85 on each of the lots or a
total amount of $1,629.95 in excess of the amounts levied for
the various improvements.
I, therefore, recommend that said sum be refunded to the R & W
Realty Company subject to the approval of the Corporation
Counsel.
