RESOLVED, upon the pertinent appeal, sander the Zoning Code,
by Ballard � . Inc as owner of the subject premises situate
in the City: of �aint Paul, described as Lots 5-thru 30 except
portion taken for streets, Pigootb s Addition, to the City of
Saint Paul Ramsey County Minneso tai located on the east side of
Homer between West Seventh Street and Benson Avenue, that the
provisions of said Zoning Code hereby are determined and varied
in application, as necessary therefore and the building setback
line applicable to said premises in respect of the north line
of Benson Avenue upon which the same abut, hereby is established
as a line drawn across said premises parallel thereto and zero
(011) feet distant from said north line of said Benson Avenue; and

RESOLVED FURTHER, upon due consideration of the application
of said Ballard Inc., owner of the subject premises for a permit
for the installation, maintenance and operation of a 29 -car
employee parking lot and truck loading area, a-permit hereby
is granted for said 29 -car employee parking lot and truck loading
area on said premises, in accordance with the plans to be sub-
mitted; all subject to compliance by said appellant - applicant and
its successors and assigns, with all applicable ordinances,
State statutes and rules and regulations of public authorities
having cognizance.

Dear,Sir:
This is in the matter of Ballard Inc.'s 1) appeal to establish a
zero (0') foot parking lot setback from Benson Avenue and 2) appli-
cation for a 29 car employee parking lot and truck loading area on,
property located on the east side of Homer Street between W. Seventh
Street and Benson Avenue which is described as Lots 5 thru 30 ex.
portion taken for streets, Pigtotg s Addition The property is zoned
commercial and light industry. D

The subject property has recently been developed with three new
structures.! The structure fronting directly off W. Seventh Street
is the 'new office and warehouse building of the applicant; the
building fronting off Homer Street at the west end of the site is the
truck repair shop and the building situated at the southeast corner
of the site'and fronting on Benson Avenue is an office building now
occupied by !the Adrian Drew Company. The remaining part of the tract
will be used'for off- street parking and truck storage and loading area.
There will be four driveways off Benson Avenue. The applicant is re-
questing a zero foot parking lot setback,from Benson Avenue for Lots 15
thru 26. Presently a 13 foot setback is required from Benson Avenue
because of other lots in this same block which are classified in the
"B" residence district. Council authorization is therefore required
to deviate from this 13 foot setback.
The Board of Zoning considered the parking lot application at its
regular meeting on April 6, 1964 at which time the staff reported
that the parking lot proposal met all of the required standards and
had been approved by the Traffic Engineer. The matter of the estab-
lishment of a zero foot parking lot - setback from Benson Avenue was
considered at the Board of Zoning meeting of August 27, 1964. The
staff reported that the Traffic Engineer had found that the 13 foot
setback as required would still provide sufficient room for the
maneuvering of the trucks. However, the applicant stated that when
there were a ;number of trucks on'„the'- lot;; there would not be sufficient
room for maneuvering. The Board felt that the requested setback was
reasonable and that it would not have a detrimental effect on the
residentially zoned property.to the east.;, and recommended approval of
the setback as requested,-and ofthe parking lot.*

APPEAL IS TO REQUEST THAT THE SETBACK OF THE PARKING LOT FROM THE STREET LINE
OF BENSON AVENUE BE ESTABLISHED AT O FEET. THE REASON THAT THIS APPEAL IS
NEEDED IS THAT CHAPTER 60.23, SECTION 5,-PARAGRAPH C OF THE LEGISLATIVE CODE
REQUIRES A MINIMUM SETBACK FOR SUCH LOTS OF 13 FEET. THIS APPEAL IS MADE UNDER
CHAPTER 64.03 .,PARAGRAPH I OF THE LEGISLATIVE CODE.
