JAN ORDINANCE TO PRESERVE THE PUBLIC HEALTH
BY LICENSING AND REGULATING THE DISTRIBUTION AND
VENDING OF ICE OFFERED FOR SALE WITHIN THE CITY
OF SAINT PAUL AND PROVIDING FOR EXPIRATION AND
REVOCATION OF LICENSE AND FOR PUNISHMENT OF VIOLATION
THEREOF. THIS IS AN EMERGENCY ORDINANCE RENDERED
NECESSARY FOR THE PRESERVATION OF THE PUBLIC PEACE,
HEALTH,AND SAFETY.
THE COUNCIL OF THE CITY OF_SAIENT PAUL DOES ORDAIN:
Section 1. License Required. No person, firm, or corporation
shall sell or offer for sale ice, either artificial or natural,
through an ice- vending machine or an automatic or semi - automatic
coin - operated machine which vends ice, in any form, for human con-
sumption, in the City of Saint Paul, without first complying with
the provisions of this ordinance and obtaining a license therefor
from the Council of the City of Saint Paul and paying a license
fee as hereinafter provided.
Sec. 2. Definitions. An ice- vending device, as the term is
used herein, shall be construed to include any machine, device,
or apparatus for the storing and delivery of ice to a purchaser,
which ice is in a form of prepackaged cubes, shaved ice, or blocks
of iee,fthe delivery of which can be made without the assistance
of an agent or employee of the licensee or an ice company.
Sec. 3. Regulations. The premises whereon such ice- vending
device is located shall be kept in a clean and saintary condition
and free from refuse, flies, vermin, and rodents.
Each device shall bear a legible notice of the telephone
number and address of an agent of the licensee to contact if such
ice- vending device is observed to be defective or does not deliver
ice when coins are inserted in accordance with directions.
Each device must be located in a room, area, or space which
can be maintained in a clean condition and the space around the
machine!itself readily cleaned. The location, if•:open and
accessible by the general public day or night, must be located
in an area that has an average maintained illumination of nne -half
foot candle.
All ice must be fit for human consumption. All ice, before
being offered for sale to the consumer, shall be free of dirt and
debris from packing and storage substances.
Sec. 4. Fee. Each ice = wending device must have a license,
and the fee for such license shall be $12.00.

Sec. 5. Duration. All such licenses shall be for a
period of one year fr6m and after the date of issuance.
Sec. 6. Application. Anyone desiring a license to engage
in the business of selling or offering for sale ice, either
artificial or natural, through an ice vending machine or an
automatic_ or semi - automatic coin - operated machine which vends
ice, in any form, for human consumption, in the City of Saint Paul,
shall make application therefor to the License Inspector of the
City of Saint Paul, stating thereon the kind of business the ap-
plicant desires to engage in, its location, the address of the
applicant, and such other information as is required by the
Licensed Inspector. Thereupon the License Inspector shall refer
the application to the Chief Health Officer of the City, who
shall make the necessary inspection and tests to determine that
the ice'to be sold meets the requirements and purposes of this
ordinance, and shall make such inspection of storage places,
vehicles used in transporting, and buildings used for retail
sale as'shall be necessary to insure that the ice shall always
be in alclean and sanitary condition.
The Health Officer shall state on such application whether
it is approved or disapproved. No license shall be granted unless
such approval of the Health Officer is given. When approved, the
application shall be transmitted to the City Clerk, together with
the license fee herein provided, and such City Clerk shall issue
to the applicant the license as herein provided.
Seca 7. Inspection. It shall be the duty of the Health
Officer from time to during the life of any license granted
hereunder�to inspect the place of business of the licensee to
ascertain ,, ,that the same is conducted in a proper, cleanly, and
sanitary manner, and to make such further inspection and tests
to determine that the ice sold or handled by such licensee is
clean andjsanitary, and if such inspection reveals that the
business is not so conducted or that the ice is not as required,
he shall make report of the fact to the Commissioner of Public
Safety, who shall transmit the report to the Council. The conduct
of his business by any licensee hereunder in an unclean or unsan-
itary manner, or the sale of ice which is not clean and sanitary,
shall be cause for the revocation of any license issued under
this ordinance.
Sec. 8. License Revocation. Any license issued under and
pursuant to the provisions of this chapter may be revoked by the
Council at any time, upon conviction of any licensee for any violation
of this ordinance of any part thereof.
