06-702Suspension - July 26, 2006 Presented By RESOLUTION CITY OF SAINT PAUL, MINNESOTA Council �11e # _ ���� Green Sheet # -�. l 2 WF3EREAS, The City Council has been advised that the general condirionat use standards which 3 are applicable to any land use first permitted pursuant to a conditional use permit, may not be 4 fully applicable to an adult entertainment use; and 5 6 WI�REAS, The City Council desires that City staff and the planning commission prepare a 7 study and report on the matter so that the Council can deternune whether to amend the City's 8 zoning regulations pertaining to conditional use pernrits for adult entertainment uses; and 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 WFIEREAS, For the purpose of protecUng the public heaith, welfare and safety and to preserve the status quo, the City Council desires to temporarily regulate adult entertainment uses pursuant to an interim ordinance under Minn. Stat. § 462.355, Subd. 4. while City staff and the planning commission undertake the study and submit a report and recommendation to the City Council for action based upon the study; NOW, THERF,FORE, BE TT RESOLVED, Pursuant to Minn. Stat. § 462355, Subd. 4, the Council of the City of Saint Paul hereby directs City staff and the planning commission to undertake a study of the City's regulatory zoning ordinances relating to conditional use pernrits for adult entertainment uses and submit a report and recommendation to the Council based upon the study so that action may be taken by the Council and made effective within the time set forth in Minn. Stat. § 462.355, Subd. 4 or earlier as the case may be; and, be it FIJRTI3ER RESOLVED, Pending the completion of the said study and the enactment of any amendments to the zoning code, for the purpose of preserving the status quo with respect to adult entertainment uses, and for the purpose of protecting the health, weifare and safety of the public, the City Council, under separate ordinance, shall prohibit the issuance or approval of any zoning pernrits, building permits, or plat and lot split approvals, for the establishment or relocation of any adult entertainment use for a period of time not to exceed one year from the effective date of this interim ordinance process as allowed under Minn. Stat. § 462355, Subd. 4 or until such time as the City Council has taken action on the recommendations contained in the study; and, be it FL7RTHER RESOLVED, Pending the adoption of the said interim ordinance pursuant to the processes set forth under City Charter §§ 6.05 and 611, passage of this resolution shall commence the effective date of the provisions of the said interim ordinance and, further, that the terms of this resolution shall expire upon the effective date of the said interim ordinance; and, be it FCTRTHER RESOLUED, That un61 such time as the said study has been completed and the City Council has reviewed its recommendarions for possible adoption and the effective date of any adopted recommendation, City departments receiving written applications for the approvals noted above shall accept the applicarions and immediately process them in accordance with the provisions of Minn. Stat. § 15.99, Subd. 2 consistent with the intent of this interim ordinance; and, be it t�� 2 FINALLY RESOLVED, That the interim ordinance and its provisions shali not be applicable to 3 any relocation of the adult uses presently operating at 674 University Avenue, which may result 4 based upon a redevelopment plan of the Saint Paul Housing and Redevelopment Authority, 5 provided that the relocation of any of the said adult uses specifically complies with I.eg. Code § 6 61.501(a), (b) and (e) and any other standard and condition specifically applicable to adult 7 entertainment uses.
