RESOLVED, That the Council of the City of Saint Paul hereby
grants a permit to Commonwealth Electric Co., a corporation, a per-
mit to maintain a tgmporary, two -inch conduit pipe from Northern
States Power Company's transformer vault on the east side of Cedar
Street near the Minnesota Building, across Cedar Street to a shaft
in the center of Cedar Street, said conduit pipe to be used during
the period of construction of a tunnel running from said shaft to
the Court Block, subject to the following terms, provisions, and
conditions:
1. The Commonwealth Electric Company shall agree to
indemnify and hold harmless the City of Saint Paul
against all expense and liability on account of all
claims, suits and judgments arising out of or con-
nected with personal injury or property damage a-
rising out of, or by virtue of the work on instal-
lation contemplated by the permit hereby granted.
2. Next, that in addition to the foregoing requirement,
the Commonwealth Electric Company shall submit to
the City of Saint Paul a comprehensive liability
p- olicy,•satisfactory to the Corporation Counsel of
the City of Saint Paul, naming the City as an in-
sured or as a co- insured with the Commonwealth
Electric Company, which shall protect the City
against public lialility for damage to property
occurring or arising out of, or by virtue of said
work contemplated by the issuance of said permit,
the minimum amounts of such public liability in-
surance to be as follows:

2. for property damage in any one addident.
In addition thereto, such policy shall
provide, as to the Commonwealth Electric
_Company, that it shall cover contractual
liability contemplated by the requirements
set forth in this Resolution.
3. Finally, a duly authorized officer of said Commonwealth
Electric Company shall submit to the City Clerk a letter
from said Commonwealth Electric Company agreeing to abide
by and be bound by the terms, provisions, and conditions
set forth in this Resolution.
