operate an off - street parking facility on property classified in "C"
Residence District at the southwest corner of Ann and Superior Sts.,
also described as Lots 1 and 2 except the south 27.5 feet, Lots 3 and
40 Block ].], D. W. Hawke's Subdiv. of Winslow's Addition AND their

This is in the matter.of. the Chas.- A_.Godbout Funeral Home Inc.'s
1) appeal to install and operate an off - street parking facility on _
property classified in -the "C ":residence district and 2) application
for a 32 car off - street parking lot nn property located at the south-
west corner of Ann and Superior,Streets,which is described as Lots 1
,and 2 except the south 27.5 feet; Lots 3 and 4, Block 11, D. W. Hawke's
Sub.Div. of Winslows Addition. The property'is zoned "C" residence.
The subject property is -an "T' §haped•tract of land having a front-
age of 191.2 feet on the south side of Superior Street and 89.5 feet
on the west side of Ann Street and results in an area of approximately
19,362 square feet. - -.In, order to install the parking lot on property
classified "C"-residence,' it" is necessary -to ;secure Council approval
under Chapter 64.03, paragraph "m" of the Legislative Code.
The Board of Zoning considered this matter at its regular meeting on
July .1, 1964. The staff reported that the application qualified
for consideration under the above mentioned Cbapter 64.03, {gar. "m"
and that the plans met the standards for this type of facility and,
had been approved by the Traffic Engineer. Based on these findings
and the need for off - street parking in this area, the Board of Zoning
recommends granting both the appeal and the application for a 32 car
off-street parking lot in accordance with final plans dated August 17,
1964. On July 2, 1964, the City Council granted an informal approval
of this proposal.

This office represents Charles A. Godbout Funeral Home, Inc. and in
behalf of our client filed ah application for special council use
permit, on April 7th, 1964, to.. operate a parking lot to be used in
connection with the mortuary.`�
The legal description of the``parking lot is:
Lots One (1) and Two (2), except the South 28.5 feet thereof,
and Lots_ Three (3) and Four (4), Block Eleven (11.y� of E. W.
Hawke's Subdivision of Winslow's Addition to the city of St.
Paul, according to the plat thereof on file and of record in
the office of the Register of Deeds within and for said Ramsey
county, state of Minnesota.
The parking lot will be situated on the Southwest corner of Superior
and Ann Streets which is to the rear of the mortuary.
The land use has been vacant lot and the remainder sub- standard dwellings.
The proposed use of the land that is a hard surfaced parking lot en-
closed by a railing will serve a two fold purpose in that it will remove
sub- standard dwellings from the area, alleviate traffic congestion by
affording patrons of the mortuary f the street parking as the capacity
of the parking lot will allow for 35 vehicles.

This appeal is necessary in order that an amendment may be adopted
to Ordinance No. 12233, Council File No. 207919, enacted July of
1964, which bribfly allows for Construction of a parking lot in an
area zoned C, residential, where the land is adjacent to the com-
mercial extablishment save and except for separation by an alley.
This was amended to include the word "street', and to thus read
'°street or alley."
The appeal is needed to prevent an injustice to the property owners
as through mistake or oversight. They were advised during the
course of purchasing said property that it could be used for a park-
ing lot and in reliance of this oral representation, proceeded to
purchase the property.
This appeal is made in accordance with the authority set forth in
the legislative code, Chapter 6403, paragraph M.

You are hereby notified that the Council of the City of St. Paul will
consider the matter of the application of Charles A. Godbout Funeral
Home Inc. for the following:
1) Appeal to install and operate a 35 -car off - street parking
lot on property consisting of at least 3 platted lots and
classified in the 11C" Residence District which is immed-
iately across a public street from property classified in
a Commercial District and is so employed and which use is
accessory thereto.
2) Permit to install and operate a 35 -car off - street parking
lot.
The property is described as Lots 1 and 2 except south 28.5 feet;
Lots 3 and 4, Block 11, E. W. Hawkets Subdivision of Winslows Addition
and is located on the southwest corner of Ann Street and Superior
Street.
A public hearing will be held in the Council Chambers of the Court
House and City Hall in the City of St. Paul, at 10:00 a.m.. on
August 20, 1964.
