WHEREAS, the City of Saint Paul, Minnesota is undertaking construction
and improvement of a certain highway designated as the Arch Pennsylvania Highway

abutting Mt. Airy Homes, Low Rent Housing Project Minn. 1 -3 on the North which

highway construction will require the cutting of slopes and fills upon the land
comprising said Project located in the County of Ramsey, State of Minnesota, more
fully described as follows:
All that real property lying between the Sly line of
Pennsylvania Avenue and the following described line:
beginning at a point on the Wly line of Lot 2, Block 1,
Mount Airy Homes Add'n, 124' SEly of the NW. Corner; thence i
deflecting left an angle of 1290 -00' a distance of 72';
thence deflecting to the right an angle of 540 a distance
of 52'; thence deflecting to the right an angle of 250 -30'
a distance of 37'; thence deflecting to the left an angle'

WHEREAS, the lands to be acquired by said City can be finally determined
only after completion of said construction and said City will acquire such land
and pay to the Housing and Redevelopment Authority of the City of Saint Paul,

Minnesota compensation in an amount or kind satisfactory to said Authority and

the Public Housing Administration.

NOW THEREFORE, the Housing and Redevelopment Authority of the City of
Saint Paul, Minnesota in consideration of the sum of One ($1.00) Dollar and other
sufficient consideration, hereby gives to the City of Saint Paul, Minnesota the
right to go upon the hereinbefore described real property and to cut slopes and

make fills thereon in connection with the construction of Arch Pennsylvania
Highway. In accepting this Temporary Permit the City of Saint Paul, Minnesota
agrees as follows:

(a) to defend and save harmless the Authority from any
and all claims or damages of whatsoever nature arising
out of the entry by said City, its agents, employees
or contractors upon the hereinbefore. described premises,`
and to cause the Authority to be named as an insured
under a public liability insurance policy issued by an
insurance company satisfactory to the Authority having
minimum limits of $50,000.00 in event of injury to one i
person and $100,000.00 in event of injury to more than
one person together with $25,000.00 for property damage,!
and, upon request, to deliver a duplicate insurance
policy evidencing such coverage to the Authority. i

(b) to construct and maintain a fence upon the Southerly
line of the hereinbefore described premises of a type
and heighth satisfactory to the Authority. j
(c) to provide compensation to the Authority in money or }
ah kind" in an amoun���JJ 1 E "byRgRe Authority and the City
tie Public Housing Administration for all that part
of the hereinbefore described premises as it shall
become necessary to acquire to maintain slopes in
connection with the construction of Arch Pennsylvania
Highway.
The permit granted'herein shall terminate on November 1, 1965.
