The basis for the recommendation is as follows: On January 30, 2006, you were sent a lefter from Kristina Schweinler, Senior License Inspector, from the Office of License, Inspections, and Environmental Protection. In her letfer, she stated that the petition you snbmitted for a Liquor-Outdoor Service Area (Sidewalk) license did not have the required 90% of signatures of atl owners of all private residences, dweIlings and apartment houses located within 300 feet of the proposed outside service area. The petition you submitted had only 33 percent of fhe required signatures. In order to achieve 90%, you would need have at least 119 signatures. As of today's date you have not submitted a petition with 90% of signatures required. .4A-ADA-EEO Bmployer Tavem on Grand June 22, 2006 Page 2 � At this time you have four options on how to proceed: (_. ��o '�O� / ff you wish to do business in the City of Saint Paul, you need to subznit the requested documents to the Office of License, Inspections and Environmental Protection at 8 Fourth Street East, Suite 200, St. Pau1, Nfinnesota 55101-1002 no later than Monday, July 3, 2006. Information should be directed to the attention of Christine Rozek. 2. If you wish to have a public hearing before the Saint Paui City Council, you will need to send me a letter with a statement ad.uutting the facts and requesting a public hearing. We will need to receive your letter by Monday, July 3, 2006. The matter will then be scheduled before the City Council far a public hearing to determi.ue whether to deny your license application. You will have an opportunity to appeaz before the Council and make a statement on your own behalf. 3. Lf you dispute the above facts, you can request a hearing before an Administrative Law Judge. At that hearing both you and the City will be able to appear and present witnesses, evidence and cross-examine the other's witnesses. The St. Paul City Council will uitimately decide the case. Lf tlus is your choice, please advise me by Monday, July 3, 2006, and I will take the necessary steps to schedule the administrative heazing. 4. You may withdraw your license application. Send a written statement to that effect to the Office of License, Inspecfions and Environmental Protection, 8 Fourth Street East, Suite 200, St. Paul, Minnesota 55101-1002 no later than Monday, July 3, 2006. Information should be directed to the attention of Christine Rozek. Any request for a refund of the license application fee must also be made in writing to the Office of LIEP. If you have not contacted me by that date, I will assume that you do not contest the denial of your license application.
