RE: Legislative Hearing Officer Report on license application for David Gigerich, CEO,
Great Western Recycling Industries, Inc., Recycling Processing Center License at
521 Barge Channel Road
Josephine M. Lopez, CEO of Great Western Recycling Industries, Inc., has applied for a
Recycling Processing Center License at 521 Barge Channel Road. This license is considered
Class N; therefore, neighbors were notified. I received one letter by the scheduled response
date of June 30, 2006.
The letter was received from Josephine M. Lopez, 427 Robie Street East. Ms. Lopez's
objections are as follows: the business is too big already, it was flooded from the river one
year, the area does not need more dumping, and the railroad is nearby as well as Our Lady of
Guadalupe Church.
Racquel Naylor, Secretary, tried to find a phone number for Ms. Lopez through various means.
A letter was sent to Ms. Lopez and mailed on July 3 requesting that Ms. Lopez call City Council
Offices by July 10 to schedule a Legislative Hearing in this matter. As of July 19, a call has still
not been received from Ms. Lopez.
Given the above information, I am recommending that the City Council approve the resolution to
grant the license for Great Western Recycling Industries, Inc. for the following two reasons: 1) it
appears that Ms. Lopez does not want to be reached regarding her letter because she did not
include a phone number and did not respond to the letter sent to her, 2) there is nothing specific
enough in Ms. Lopez's letter for conditions to be developed upon.
