� WHEREAS, Riverstone Development Group LLC, in File No. 06-072-534, has submitted for
a City Council approval the attached preliminary and final plat for Hazel Gardens, subdivision of
s property between Wilson & Hudson, to create 10 residential lots and 1 outlot; and
� WHEREAS, the appropriate City departments have reviewed the plat and found, subject to
s the recommended condition, that it meets the requirements of Chapter 69 of the Zoning
9 Code; and

ii WHEREAS, notice of a public hearing before the City Council was duly published in the
i2 official newspaper of the City and notices were mailed to each owner of affected property
t3 including all property situated within 350 feet of the subject property; and

is WHEREAS, the City Council held a public hearing on the proposed plat on July 5, 2006,
16 where all interested parties were given the opportunity to be heard, and the Council
i� considered all the facts and recommendations concerning the plat;

t9 NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the
2o attached preliminary and final plat for Hazel Gardens subject to the condition that the
2i applicant shall file a copy of the Council Resolution approving the plat with the Ramsey

A. PURPOSE: Combined Plaf for Hazei Gardens to create 10 residentiai lots and 1 outlot
B. PARCEL SIZE: approx. 120 ft. (Hazel) x 297 ft., with a total lot area of 35,663 sq. ft.
C. EXISTING LAND USE: 10-unit townhouse development
D. SURROUNDtNG LAND USE:
North: single family residential, multiple family residential (R3, RM1)
East: single family residential (R3)
South: parking, commercial (VP, 62, B3)
West: multipie family residentiai (RM2)
E. ZONING CODE CITATION: §69.301 states that platting is required when a subdivision (1) creates
five or more lots or parceis each of which is 2% acres or less in size, or (2) requires paved streets,
alieys and other pubiic improvements, or (3) is previously unplatted land. §69.304 lists conditions
for lot splits and adjustments of common boundaries. §69.406-provides criteria for review of
subdivision applications. These criteria are covered below under "Required Findings °
F. HISTORY/DISCUSSION: This project was approved in 2004 and 2005 with a rezoning (File # 04-
165-087), variances (File # 04166-931) and site plan (File # 05-107-748).
G. DISTRICT COUNCIL RECOMMENDATION: The District 1 Council had not commented at the
time this staff report was prepared.
H. FINDINGS: § 69.406 of the Zoning Code requires that ali of the following findings shall be made
prior to approval of a subdivision:
1. All the applicable pmvisions of the Legislative Code are complied wifh. City staff have
reviewed the proposed plat and have determined that all applicabie provisions of city codes
are met.
2. The proposed su8division wifl not be detdmenfal to fhe p2sent and potential surrounding
land uses. The proposed piat is consistent with the surcounding land uses, and wiil nof be
detrimental to present and future use of surrounding land.
3. The area surrounding the subdivision can be planned and deve%ped in coordination and
compatibilify with the proposed subdivision. The area surrounding the proposed piat is
aiready developed and compatibie with the proposed ptat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision is in
conformance with the Housing chapter of the comprehensive pian, which cails for a range of
housing types and values in the City. It aiso conforms to redevelopment plans for the area.
5. The subdivision preserves and inco�porates the site's imporfant exisfing natural features
whenever possible. The site is in a fuliy-developed part of St. Paul with no remaining naturai
features.
6. All land intended for buiiding sites can be used safely without endangering residents by peri/
from floods, erosion, continuously high water table, severe soil conditions or other menace.
The site is a flat, fully developed area with no flooding, erosion, high water tabie or soii
condition problems.
• 7. The subdivision can be economically served with public facilities and seivices. The

STAFF RECOMMENDATION: Based on required findings 1 through 7, stafF recommends
