WHEREAS, Neighborhood Housing & Property Improvement has requested the City Council
to hold public hearings to consider the advisability and necessity of ordering the repair or
wrecking and removal of a two-story, masonry/wood frame duplex and the detached, two-
stall, masoary/wood frame garage located on property hereinafter referred to as the "Subject
Property" and commonly l�own as 1515 Carroll Avenue. This property is legally described as
follows, to wit:
Lot C and Lot 14, Block 2 Macalester View Addition to the City of St. Paul
WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Neighborhood Housing & Property Improvement on or before March 14, 2006, the
following are the now known interested or responsible parties for the Subj ect Property: Raymond
Heichel, 596 Portland Avenue, St. Paul, MN 55102; Thomas Bertram Wake, 942 Sherburne Avenue,
St. Paul, MN 55104
WHEREAS, Neighborhood Housing & Property Improvement has served in accardance with
the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated May 08, 2006; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair ar
demolish the structure located on the Subject Property by May 23, 2006; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Froperty declaring
this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Neighborhood Housing &
Property Improvement requested that the City Clerk schedule public hearings before the
Legislative Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accardance with
the provisions of Chapter 45 of the Saint Paul Legislative Code, of the tnne, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legisiative Hearing Officer of the Saint Paul City
Council on Tuesday, July 11, 2006 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by rehabilitaring
this structure in accordance with all applicable codes and ordinances, or in the altemative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.

WF3EREAS, a hearing was held before the Saint Paul City Council on
Wednesday, July 19, 2006 and the testimony and evidence including the action taken by the
L,egislarive Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1515 Carroll Avenue:
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
three thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Neighborhood Housing & Property Improvement has posted a placard on the
Subject Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Neighborhood Housing & Property
Improvement, Vacant/Nuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance
Building(s) in accordance with all applicable codes and ordinances, or in the
alternative by removing the shucture in accordance with all
applicable codes and ordinances. The�gl��er� demolition and removal of the
structure must be completed within �'tf�Eec�r{}5}days after the date of the Council

Neighborhood Housing & Property Improvement is hereby authorized to take
whatever steps aze necessary to demolish and remove this structure, fill the site and
charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul I,egislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and
removal shall be removed from the property by the responsible parties by the end of
this time period. If all personal property is not removed, it shall be considered to be
abandoned and the City of Saint Paul shall remove and dispose of such property as
provided by law.
4. It is fiirther ordered, that a copy of this resolution be mailed to the owners and
interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Nei�hborhood Housing & Property Improvement has declared this buildin�(s) to constitute a
"nuisance" as defined by Legislative Code, Chapter 4�. Neighborhood Housin� & Property
Improvement has issued an order to the then known responsible parties to eliminate Ihis nuisance
condition by correcting the deficiencies or by razin� and removin� this buildin�(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition
remains unabated, the community continues to suffer the bli;htin� influence of this
property. It is the recommendation of the Nei�hborhood Housin� & Property
Improvement that the City Council pass a resolufion ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Neighborhood Housing & Property Improvement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special

A caller identified as John will not be able to come to the hearing, but wanted to voice his opinion. He is
all in favor of demo for this house. During the 17 years that he has lived in this neighborhood, 1515
Carroll has been an eye-sore. There was junk al! over the place & the porch was filled with garbage. He
doesn't know how people lived there because the house was in such poor condition. He had called the
Health Dept many times. It seemed to be drug infested. Peopie would come & live in fents and frai(ers
around the house.

3. Resolution ordering the owner to remove or repair the building(s) at 151 S Carrofl Avenue. If �
the owner fails to comply with the resolution, Neighborhood Housing and Proper[y
Improvement is ordered to remove the building. (NE�I)
Mr. Magner stated the building was a two-story, masonry, wood duplex on a lot of 7,405 square
feet. The building had been vacant since January 17, 2006 due to a fire that included one
fatality. The irispector believed the building was being used as an illegal rooming house as the
fue and fatality started in the basement. The building also constituted a nuisance as there had
been four summary abatements at the property: i) norice to remove garbage, rubbish, scrap
wood; 2) norice to cut talI grass and weeds; 3) norice to remove a vehicle; and 4) notice to
remove snow and ice. He considered the building to be a dangerous structure as the bricks were
falling away from the house on the west side and two to three feet from the neighbor's driveway.
The vacant building fees had been paid, however, a code compliance inspection had not been
conducted. According to Ramsey County Taacation, the taxes for 1994 and 1995 were
delinquent, however, the owner had signed a confession of judgment and is making payments on
the outstanding balance of approximately $6,000. There was also an outstanding balance of
approximately $2,000 on the Contract for Deed owing to a Raymond Heichel. Taxation had
placed an estimated market value of $99,100 on the land and $48,300 on the building. The
estimated cost to repair the building was approximately $80,000 to $90,000. The estimated cost
to demolish the building was approximately $7,000 to $10,000. It was his opinion that this
boarded building was also an attractive nuisance and a place for youth to congregate, therefare,
he recommended demolition since it was also a dangerous structure.
Thomas Wake, property owner, stated he had owned this properiy for over 18 years and still had
approximately 80% of his belongings in the building. It was his intenrion to sell the property and
he was currently negotia6ng with a realtor.
Timothy Mangan, representing the Snelling-Hamline Community Council, sfated the neighbors
had lost their patience over this property and would like to see the house removed since the
structure is in such bad shape and is an eyesore to the neighbarhood. The neighbors would like
to see the land remain green space and he suggested perhaps the County could do a controlled
burn on the building rather than paying the cost of demolition.
Ms. Moermond stated the estimated cost for demolition was $7,000 to $10,000, however, this
estimate could be higher since there had been a fire and hazardous material would need to be
taken to a Iandfill that could accommodate such materiaL If Mr. Wake chose to have the city
complete the demolition, the cost could be applied to his property tases and the payments couId
be spread out over several yeazs. He could also hire a licensed excauating company and pay the
cost himself.
Ms. Moermond recommended laying over to the July 25, 2006 Legislative Hearing if the
following conditions are met by noon on July 19, 2006: 1) a code compliance inspecrion is
compteted; 2) a$5,000 performance bond is posted; and 3) a signed purchase agreement with a
qualified professional is obtained who can demonstrate the fmancial ability to complete the
necessary rehabilitation to the building. If the conditions aze not met by the deadline, the
recommendation is for demolition of the building within ten (10) days.

I unfortunately was not able to attend today's public hearing in regards to
Yhe vacant house at 1515 Carrol! Avenue. As a direct neighbor to this house
1 believe I share many of the same opinions as other residents/home owners
in the area. I don't beiieve the structures on this property can be
improved through any amount of maintenance. For the safety of the
neighborhood and communiry the strucYures should be removed.

I am unable to attend the hearing meeting this morning, so I will send my thoughts in an e-mail. i am a
long time residenf of fhe neighborhood where this building is Iocated. This buiiding at 1515 Carro(I
Avenue suffered a fire in January, 2008 where an individual died. Based on the coverage by the local
media, the building did not have running water, or heat. When the fire department entered the home to
put out the fire, they had much difficulfy getting tfirougfi fhe home due fo all the clutter. At ffiis poinf in
time, it is my understanding that this building at 1515 Carroll Ave has received an Abatement Order. I am
recommending that you vote to have this building torn down. The building is not up to code and the
present owner has not made any indicafion thaf he has fhe means to get fhe building up to code.
Because the building is not up to code, it has safety issues. There are many children in the neighborhood
and this building would be a"fun" place to explore.
Please make your recommendation fo the City Council fo have the building desfroyed. Thank you for
