WHER�e�lEer 293 of the Salnt Yaul l,egislative Code was enacted to regulate the sub�ect oi
noise in the City of Saint Paul; and
WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hazdship on the app]icant, other persons or on the community; and
WHEREAS, McGough Construction Co., Inc., represented by Dave McLaughlin, Project
Manager, who has been designated as the responsible person on the application, has applied for a
variance to operate demolirion equipment and power tools; and
WHEREAS, applicant is seeking a variance for the hours of 7:00 a.m. to 10:00 p.m., Monday thru
Friday and 8:00 a.m. to 5:00 p.m. Saturdays, starting August 1, 2006, until December 31, 2008; and
WHEREAS, if applicant is not �anted a variance it will not be able to operate demolirion
equipment and power toois at 69 W Exchange Street; and
WI�EREAS, the OfFice of License, Inspections, and Environmentai Protection has reviewed the
application and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to McGough
Consriuction Co., Inc., subject to the following conditions:
1) The variance shall be for the hours of 7:00 a.m. to 10:00 p.m., Monday tbru �riday and
8:00 a.m. to 5:00 p.m. Saturdays, starting August 1, 2006, until December 31, 2008.
2) McGough Construction Co., Inc., shall take all practical steps available to minimize the
noise levels during this period which do not otherwise unduly hinder the project or
unreasonably increase the costs of the project.

FURTI�R RESOLVED, that any violations of the conditions set forth above on the August 1,
2006, unril December 31, 2008, dates may result in denial of future requests for the grant of a noise
variance, in addirion to any criminal citarion which might issue.
