Adopfion Cer6fied by Coxn�cil Secretary: By: r Approved by`1Vlayor: Date: Approved by Mayor Submission to Council: : � 3(t`UC� # OC� — ��� � Q:\Fiscal W O&CR�2006\RussGarveyintra.-govementaiRC2006.ccxis �{p �� � AGREEMENT BETWEEN RAMSEY COUNTY, RAMSEY COUNTY SHERIFI"S OFFICE �ND CPTY OF SAINT PAUL, POLICE DEPARTMENT This intergovemmental mobility agreement (Agreement) is hereby entered into effective the day of , 2006, by and between the County of Ramsey acring through its Sheriff s Office (hereinafter "RCSO") and the City of Saint Paul, Police Department (hereinafter "City"). _ WHEREAS, Russ Garvey is a regular employee of the City, in the position of Police Officer with certain rights as a City employee; and WHEREAS, the parties agree that Russ Garvey be granted an intergovernmental mobility assignment from the City to the Ramsey County Sheriff's Office to assume the duries described; and WHEREAS, this agreement is authorized by and subject to Minnesota Statutes 15.51 — 15.59 (inclusive); NOW THEREFORE, the parties hereto and their respective agencies hereby agree as follows: 1. Effective March 4, 2006, or as soon thereafter as approved by the parties hereto, Russ Garvey will be placed on an intergovemmental mobility assignment from the Ciry to the RC30 for an initial period of ] 0 months, March 4, 2006, through December 31, 2006. This assignment may be extended for an additional 12 months upon written agreement by the City and the Ramsey County Sheriff. 2. Under direction of Sheriff Bob Fietcher, Russ Garvey will facilitate canine training for the Sheriffls Office. 3. As Russ Garvey serves at the pieasure of the Sheriff, this Agreement may be terminated without notice at any time by the SherifE The Agreement may also be terminated at any time by Russ Garvey or the City with 30 days written notice. 4. T'Yie RCSO shall reimburse Russ Garvey for all expenses incurred which relate to his duties in the Felony Apprehension unit, pursuant and subject to the applicable expense reimbursement policies of the RCSO. 5. For the duration of this Agreement, Russ Garvey remains a regular employee of the City and continues to accrue and retain benefits, seniority, compensation and allowances from the Cit� in accordance with any cunent and subsequently approved City administrative procedures and/or policies and labor agreements, including any � '/o�idi increases in compensation or allowance that may occur during the effective dates of this mobility a�eement for which Russ Garvep could be eligible. Russ Garvey will comply with all City procedures related to zeceipt of allowances or use of sicklvacation time. Total compensation under this Agreement for Russ Garvey's services shall be as reflected in the current or future labor agreement between the City of Saint Paul and the Saint Paul Police �ederation and will include the cost of ail fringe benefits or overtime as identified in the labor agreement. 6. All of Russ Garvey's compensafion will be subject to the Police and Fire Plan of the Public Employee Retirement Association of Minnesota with rea lar contriburions from the City and Russ Garvey. 7. Russ Garvey will remain an acrive licensed peace officer on the City roster subject to Peace Officers Standards and Training Board ("POST") continuing education requirements. Russ Garvey may attend in-service training provided by either the City of the RCSO at his option, but is required to keep his POST license current. 8. During the term of this Agreement, the RCSO shall, upon receipt of invoice in proper form, reimburse the City quarterly, or as otherwise agreed, for all compensation and related fringe benefits costs, as outlined or as subsequently increased, paid to or on behalf of Russ Garvey from the City as described in Paragraphs 5 and 6 above, except for training or uniform allowances. Each party is responsible for its own acts and conduct and the results thereof. Each party's liability is govemed by the Municipal Tort Claims Act, Minnesota Statutes 466.02. Although the supervision of Russ Garvey's duties will rest exclusively with the RCSO, it is agreed that he is not a RCSO employee and is not entitled to any benefits from Ramsey County or the RCSO, including but not limited to, unemployment benefits, pension, sick and vacation leave, death and medical benefits except as provided in Minn. Stat. 15.54, Subd. 3 10. Nothing in this Agreement, express or implied, is or shall be construed to be an offer or promise or permanent or other employment for Russ Garvey with Ramsey County or the RCSO. 11.
