WHEREAS, the City of St. Paul owns the right of way
under the Earl Street Bridge where it crosses the Northern Pacific
Railway Company and East Seventh Street, described as follows:
"In that portion of Section 28, Range 22W,
Township 29N, beginning at a'point on the
east property line of Earl Street, 251
feet south of the centerline of York Street'
thence westerly on a line parallel to the
centerline of York Street to a point 52
feet west of the east property-line of Earl
Street; thence 61 feet southerly on a line
parallel to Earl Street; thence easterly 15.4
feet on a line parallel to York Street; thence
119.5 feet southerly on a line parallel to
Earl Street; thence north 74 002130" East, a
distance of 27.7 feet; thence 23.9 feet north-
erly on a line parallel to Earl Street; thence
10 feet easterly on a line parallel to York
Street to the east property line of Earl Street;
thence northerly on the east property line of
Earl Street to the point of beginning," and;
WHEREAS, the property under the bridge is not used by the
City exdept for bridge support and maintenance, and;

WHEREAS, the described property is adjacent to land used
by Foley Bros., Inc., which company has requested permission to store
non - comhustible material under said bridge for its convenience and
has offered to enter into a lease with the City of St. Paul upon
terms and conditions approved by the Corporation Counsel, and;
WHEREAS, it appears that the proposed use by Foley Bros.,
Inc. is not improper nor a burden on the City's use of said property,
it is, therefore;
RESOLVED, that the proper City officials are authorized to
enter into a lease for a term of one year with Foley Bros., Inc.
upon the terms and conditions as approved by the Corporation Counsel,
provided further that Foley Bros., Inc. provide a liability insurance
contract in which the City of St. Paul is also a named insured, the
limits of which are to be no less than the general statutory liability
for la, municipality as limited by Minnesota Statutes.
