RESOLVED, upon the pertinent appeal of Chris Bohler,
as owner of the west 90 feet of the south one -half of Lot 3
and the west 90 feet of Lots 4 and 5, Block 84, West St. Paul
Proper, located generally at the northeast corner of George
and Stryker, under the Zoning Code, for relaxation of the eight
(8) foot screen - planting buffer on the east and north property
lines of the above described property, which provisions are
hereby determined and varied, so as to establish in lieu of the
screen - planting buffer a five (5) foot -high basket -weave fence,
and that said applicant be permitted to construct said fence under
the direction and to the satisfaction of the Commissioner of
Parks and Recreation and Public Buildings, subject to compliance,
otherwise, with all applicable municipal ordinances, State
statutes and rules and regulations of public authorities having
cognizance.

on October 29, 1964, on the application of Chris. Bohler for
appeal to waive 8 foot required buffer for parking lots adjacent

Dear Sir:
This is in reply to the referral of the appeal of Chris. Bohler to relax
the 8 -foot screen - planting buffer along the east and north property lines
of an existing-drive -in development so as to provide for a more desirable
parking facility. The subject property is'described as: the west 90 feet
@ of the south one-half ,of Lot 3 and the west 90 feet-of.-Lots 4 and 5. Block
84,•West St.,Paul Proper and is located at the northeast corner of George
and Stryker.
The properties immediately adjacent to the north and east are developed
with residential uses. After viewing the site, it would appear that
proper buffering could be accomplished by constructing a 5 -foot high
basket -weave fence along the east and north property lines in lieu of the
present 8 -foot buffer requirement. This would allow the property owner to
utilize his property in a more orderly fashion.
The applicant has filed a letter dated September 15, 1964 from the adjoin-
ing property owner expressing approval of the requested relaxation. The
applicant's revised plan has been reviewed by both the Traffic Engineer's
office and the Planning Board staff and find same meets all of the require-
ments for this type of facility with the exception of the requested relax-
ation. ,
The Board of Zoning, after reviewing this request, finds said relaxation would
be reasonable and provide for a more desirable development and use of the
property and, therefore, recommends approval of the requested relaxation subject
to the erection of a 5 -foot high basket -weave fence along the north and east
property lines of the subject property and in accordance with the applicant's
revised plans dated September 24, 1964.

My name is Chris Bohler, and I am the Owner of the property known as the West
Ninety (90) feet of Lots 4 and 5, and the South 1/2 of Lot 3, Block 84, St. Paul,
Minnesota (West Side).

IThe above described property is located on the Northeast Corner of George St. and
Stryker Avenue. The property is presently being used as a Dairy Queen Drive -In.
I am requesting an appeal for,-the council to relax 8 foot parking lot set -back and
planting area as required in Section 60.23 Paragraph (s) of the Legislative Code.
We are making this appeal as per'Chapter 64.03, Paragraph (i) of the Legislative
Code.
Enclosed is a check in the amount of $30.00 -covetiggthe filing fee for the appeal.
Spedifically the appeal deals with the following:
1. On the East property line, we request permission to erect a fence
on the property line.,
2.' On the north property line, we request permission to erect a fence
four (4) feet south b1l the north property line.
k Both situations would obviate the possibility of a planting area. The location
!of said fences and property lines are more clearly shown on the accompanying drawing,
prepared by Associated Architects and Engineers, Inc., located at 743 Selby Avenue,
