That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain pro- perties in the City of Saint Paul, as amended, be and the same is hereby further amended s,o as to rezone the following des- " cribed property from "'All Residence District to Commercial b District, to -wit: "Except the north 100 feet of the east 133 feet thereof, that part of the east 156 feet of SE+ of Section 34 Township 29 Range 22 Ramsey County, Minnesota, lying south of Audson Road and North of Trunk Highway No. 12 except part taken for White Bear Avenue according to U. S. Government Survey thereof, and of the locations of all buildings thereon, and all visible encroachments, if any, ll from or on said land; H situate on property located adjacent to the southwest corner of White Bear Avenue and Old Hudson Road in the City of Saint Paul. Minnesota lying So. of Hudson Road and No. of T.H. #12 ex. part taken for White Bear Avenue according to U.S. Govt. Survey thereof, and of the locations of all buildings thereon, and all visible encroach- ments, if any, from or on said land. On September 23, 1964, the Commissioner -of Finance reported the petition sufficient with the owners of 4 of a'possible 5 (80%) tracts of land within the prescribed 100 foot area having signed the petition. This is an irregularly shaped tract of land which fronts along the west side of White Bear Avenue, the north side of T. H. #12, and also a small amount of frontage on Old Hudson Road and results in an area of approxi- mately 18,800 square feet. It is proposed to combine it with the ` commercially zoned property to the east and north of the subject pro- perty for the development of a filling station operation. The Board of Zoning considered this matter at its regular meeting on October 8, 1964. The staff reported that the proposed use was in accordance with the Comprehensive Land Use Plan, and that the appli- cant's plan indicates that all of the requirements of the City of Saint Paul and the Highway Department will be met.
