220840,�"q;v-sgo Council File No. 220840—By Milton Rosen — Resolved, That upon the petition of Harry I. Shapiro and John B. Pfaff, the section of public street hereinafter described, be and the same hereby is vacated and discontinued as a public street, viz.: South 233.32 feet of that part of Capitol heights lying north of the north line of that part of Capitol Heights vacated August 26, 1963; subject expressly to the following con- ditions and reservations: 1. All the conditions, reservations and provisions contained in Chapter 228 of the St. Paul Legislative Code enacted D e c e m b e r 18, 1957, as amended, regulating the procedure and prescribing the conditions for the vaca- tion hi in th public grounds, City of Saint hi and Saint in Paul. 2. That no change in the grade or surfacing of- the vacated section of street be made without the express permission of the Water Department and the Department of Public Works. 3. That street closures, drainage fa- cilities, and a turnaround satisfactory to the Department of Public Works be installed at the expense of the petitioners. j 4. That no permanent buildings be erected within teh feet of the existing sewer, water, and gas mains, and that a specific easement be retained to protect the installations of the North- ern States Power Company and the Northwestern Bell Telephone Compan y 5. The bond provided b y said sa Chapter 228, to b e peti- tioners, is hereby fixed at the sum of ;10,000. 6. Said petitioners shall pay to the City of Saint Paul the sum of 52,000 as compensation for said vacation, to- gether with the costs of this vacation proceeding. 7. That the proper City officers are hereby authorized and directed to execute such Quitclaim Deeds as neces- sary to accomplish the purposes of this petition for vacation of a public street. . Further Resolved, That the provisions of the prior resolution of this Council Council File No. 220710, adopted and approved November 18, 1984, be and the same are hereby rescinded and cancelled.
