4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
( constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, Rise Media, LLC, represented by Mick Sterling, Operating Partner, who has been
designated as the responsible person on the application, has applied for a variance to allow live music at
Harriet Island Regional Park; and
WHEREAS, applicant is seeking a variance for the hours of 3:00 p.m. unti16:00 p.m. on
September 8, 2006, for a sound check; from 2:00 pm. until 10:00 p.m. on September 9, 2006; and from
2:00 p.m. until 8:30 p.m. on September 10, 2006; and
WHEREAS, i£ applicant is not granted a variance it will not be able to present the live music far
the Wi1d River event; and
WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the
application and has made recommendarions regazding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Rise Media,
LLC, subject to the following conditions:
1) The variance shall be for the hours of for the hours of 3:00 p.m. until 6:00 p.m. on
September 8, 2006, for a sound check; from 2:00 p.m. until 10:00 p.m. on September 9,
2006; and from 2:00 p.m. unti18:30 p.m. on September 10, 2006
2) All electronically powered equipment used in conjunction with the event shall not exceed
100 dBa, as measured at the closer of the sound mix or 100 feet from the front of the
stage(s)
3) The applicant shall provide persoanel and equipment who shall provide continuous sound
level monitoring at all stages and each sound mix from 3:00 p.m. until 6:00 p.m. on
September 8, 2006; from 2:00 p.m. until 10:00 pm. on September 9, 2006; and from 2:00
p.m. unri18:30 p.m. on September 10, 2006

4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
tumed off no later than 6:00 p.m. on September 8, 2006, 10:00 p.m. on September 9, 2006,
and 8:30 p.m. on September 10, 2006
FURTHER RESOLVED, that any violarions of the conditions set forth above on the September 9,
2006, until September 10, 2006, dates may result in denial of future requests for the grant of a noise
variance, in addirion to any criminal citation which might issue.
