RESOLVED, upon and pursuant to the appeal of Fred S. Herring,
et a1, under the �oning Code, a.nd as own.ers of the sub�ect premises classified
under said Zoning Code in "A" Residence District, situate on the south side
of Montana Avenue between White Beax Avenue and Flandrau Street in Saint
Pau1, embracing in excess of three platted lots ad�oining premises classified
un.der said Zoning Code in Co�nercial District, and described as follows:

Dear Madam:
This is in reply to the Council's referral of the appeal of Fred. S.,
Herring to construct a 17 unit apartment building in an "A" residence
district on a tract of land .adjoining a commercial use. The subject
property is located on the south side of Montana Aoenue between White
Bear Avenue and Flandrau Street and is described as Lots 4, 5, 6, 7 and
the north one-half of vacated alley adjoining said lots, Block 2,
J. A. Humphrey's Sub. `�A'�. �
The subject property is vacant, approximately level, and at the street
grade of Montana Avenue. It has a frontage of 160 feet along said street
and a depth of 134 feet, resulting in a total area in excess of 21,000
square feet. The applicant makes this request pursuant to Chapter 64.03,
Section t'1", Par. 2 of the Legislative Zoning Code which requires Council '
authorization before the erection of an apartment building for more than
four families can take place in an "A" or "Bt' residence district. It is
also required that the subject property consist of a tract of land em-
bracing at least three platted lots or equivalent area immediately adjoin-
ing a commercial district or premises actually employed by a similar non-
conforming use valid at its inception. The subject property does immediately
adjoin a commercial district as well as commercial development which fronts
on both White Bear and Montana Avenues and therefore qualifies for con-
sideration. '
The Board of Zoning considered this matter at its regular meeting on
December 19, 1963, and after hearing the petitioner and Planning Board
staff report, concluded that the proposed use would provide. a proper
transitional use between the commercial activities on White Bear Avenue
and the single-family residences to the west. Therefore, it was recommended
that the appeal as outlined above be granted so as to permit the erection
of a 17 unit apartment building on the above described property.

The undersigned respec�fully appeal that your body permit the
erection of an apartment building for more than four families
in an "A'T residence district on a tract of land embracing an
area equivalent to four ci�y lots immediately adjoining a
commercial district, and set� out the following:
The full name of the applicant is Frederick S. and Florence M.
�Herring, husband and wife, who reside at 1716 Hyacinth �lvenue,
St. Paul 6, Minnesota. - �
The legal description of the property is,
Lots,l�, 5 , 6, and 7, Block 2,
J. A. Humphreys' s Subdivision �1,
according to the recorded plat
thereof filed and of record in
the Office of the Register of
Deeds of Ramsey C'ounty, Minnesota.
The street location is on the south side of East Montana Avenue
between White Bear Avenue and Flandrau. The property is
presently vacant property. The proposed use of the property
is for the construction of an apartment building consisting of
a basement and two stories.
The purpose of this appeal is to secure authority to develop
the property by the construction� of such apartment building
for seventeen units. This appeal is necessarp in order to
comply with the law under the present zoning. The section of
the ordinance appealed under is Legislative Zoning Code,
Chapter 61�.03 , Section 1, Paragraph 2.
