WHEREAS, the City Council held a public hearing on the proposed plat on June 21, 2006,
where all interested parties were given the opportunity to be heard, and the Council
considered all the facts and recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the
attached preliminary and final plat for Yorkshire Townhomes, located at the SW corner of
St. Paul Avenue and Yorkshire, subject to the condition that the applicant shall file a copy of
the Council Resolution approving the plat with the Ramsey County Recorder's Office.

A. PURPOSE: Combined preliminary and final plat for Yorkshire Townhomes to create 9 residentiai
lots and 1 outiot.
B. PARCEL SIZE: irregular parcel, approx. 130 ft. of frontage on Yorkshire and 113.6 ft. of frontage
on St. Paul Avenue, and a total lot area of 11,646 sq. ft.
C. EXISTING LAND USE: 9-unit townhouse development
D. SURROUNDING LAND USE:
Low Density Residential (R3) is located to the north, east, and south. Another multiple family
structure is located to the west of the site (RM2)
E. ZONING CODE CITATION: §69.301 sfates that platting is required when a subdivision (1) creates
five or more lots or parcels each of which is 2%z acres or less in size, or (2) requires paved streets,
alleys and other public improvements, or (3) is previously unplatted land. §69.304 lists conditions
for !ot splits and adjustments of common boundaries. §69.406 provides criteria for review of
subdivision applications. These criteria are covered below under `Required Findings."
F. HISTORY/DISCUSSION: The property was rezoned from R3 One-Family Residential to RM2-
Medium Density Multiple-Family Residenfial in 2005 (Z.F. # 05-058-569) and a site pian and
variances for fhe developmenf were approved in October, 2005 (OS-113-227). Another variance
for location of air conditioning units was approved in 2006 (06-077-131).
G. DISTRICT COUNCIL RECOMMENDATION: The District 15 Council has not commented on the
plat application, but has recommended approval of previous applications.
H. FINDINGS: § 69.406 of the Zoning Code requires that all of the foilowing findings shall be made
prior to approval of a subdivision:
1. AlI the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that all applicabie provisions of city codes
are met.
2. The proposed subdivision will not be detrimental to fhe present and potential surrounding
land uses. The proposed plat is consistent with the surrounding land uses, and wili not be
detrimental to present and future use of surzounding land.
3. The area surrounding the subdivision can be planned and developed in cooidination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is
already developed and compatible with the proposed piat.
4. The subdivision is in confomrance with the comprehensive plan. The subdivision is in
conformance with the Land Use and Housing chapfers of the comprehensive pian, which
encourage developments that promote good design solutions on smailerdevelopment sites
and which complement existing neighborhoods. The p4ans afso support providing a range of
housing types and values. It also conforms to redevelopment plans for the area.
5. The subdivision preserves and incorporates the site's important existing natural features
whenever possible. The site is in a fully-developed part of St. Paul with no remaining natural
