2 WHEREAS, on June 1, 2005, the city Council of the city of Saint Paul adopted Council File #OS-496, said
3 Resolution being the Ratification of Assessment for Property Clean-up during September and October,
4 2004 (File No. 70407A, Assessment No. 8029); and

6 WHEREAS, the property at 1588 Case Avenue, being described as:

8 Fairchilds subdivision of Lots 1, 2 and 3 of Cruickshanks Garden Lots to St. Paul Ex N 30 Ft & Ex 60 Ft
9 the N'/z of Lots 8& Ex N 30 Ft the E 30 Ft of the N'/z of Lot 9;

11 with the properry identification number 27-29-22-42-0006 was assessed the amount of $323.00 for the
12 property clean-up; and
13
14 WHEREAS, the Legislative Hearing Officer recommends deleting the assessment because the property
15 owner was not properly notified.

17 THEREFORE, BE IT RESOLVED, the amount of the assessment far this property be deleted; and
18
19 BE IT FURTHER RESOLVED, that the reduction of $323.00 be funded by the Exempt Assessment Fund.

The hearing was called to order at 10:00 a.m.
STAFF PRESENT: Harold Robinson, Neighborhood Housing and Property Improvement
(NIIPI)
1. Laid over summary abatement:
J06T1Q Providing weekly garbage hauling services at 739 Fuller Avenue.
No one appeazed; Legislative Hearing Officer recommended approval.
2. Appeal of Summary Abatement Order at 679 Lincoln Avenue; owner: Pierre George.

J0407A Property cleanup at 1588 Case Avenue, owner: Mark Sulzbach. (NHPI)
Mr. Robinson stated the properry was inspected on Apri129, 2004 and orders were issued for
fumiture and other household items. The properiy was re-inspected on May 3, 20054. On
September 7, 2004, he inspected the property and issued a summary abatement order with a
compliance date of September 13, 2004. The work had not been completed and Parks performed
the clean up of the property on September 14, 2004.
Mark Sulzbach, property owner, stated he had purchased the property on April 30, 2004 and he
never received notice of the summary abatement order.
Ms. Moermond questioned the address the notice had been mailed to. Mr. Robinson stated the
notice had been mailed to Richard and Janice Roth, 1588 Case Avenue.
Ms. Moermond stated that since legal notice had not been received by the property owner, her
recommendation was to delete the assessment.
4. J0507E Excessive Consumption of Inspection Services for Property Code Violations
Billed During November and December 2005.
441 Van Buren Avenue
Mr. Robinson stated orders were issued on November 8, 2005 to repair a broken window on the
house with a compliance date of November 21, 2005. The property was rechecked on November
21 and November 29, 2005. The properiy was still not in compliance and the window was
repaired on December 21, 2005. The total cost of the excessive consumption assessment was
$95.00.
