An Ordinance amending the Zoning Code, Chapters
60 to 64 inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts, Height Districts and
Rezoning of certain properties in the City of Saint
Paul, as amended. This is an emergency ordinance
rendered necessary for the preservation of the public
peace, health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclusive,
of the Saint Paul Legislative Code, pertaining to Use Districts, Height
Districts, and Rezoning of certain properties in the City of Saint Paul,
as amended, be and the same is hereby further amended so as to rezone
the following described property from "A" Residence District to Commercial
District, to -wit:
All except the west 50 feet of Lot 4, Block 25,
Auditor's Subdivision No. 62, St Paul Minn;
located at the southeast intersection of Highways No. 12 and No. 61
which fronts on the north side of Pacific Street and the west side of
Birmingham Street.
Section 2. This ordinance is hereby declared to be an emergency
ordinance rendered necessary for the preservation of the public peace,
health, and safety.
Section 3. This ordinance shall take effect and be in force
upon its passage, approval, and publication.

Dear Sir:
This is in reply to the referral to the Board of Zoning of the petition
of Chester M.Tobin to rezone from "AI' residence to commercial district
property located at the southeast intersection of Highways # 12 and
# 61 which fronts on the north side of Pacific Street and the west side
of Birmingham Street and is described as all except the west 50 feet of
Lot 4, Block 25, Sub. No. 62.
The subject property is vacant and has a frontage on the north side of
Pacific Street of 183.94 feet and 139.48 feet on Birmingham Street,
resulting in an area of approximately 25,654 square feet. To the west
and north adjoining is highway right -of -way; east and across unimproved
Birmingham Street is a vacant parcel classified in the residential dis-
trict; south and across Pacific Street is a filling station.
The Board of Zoning considered this petition at its regular meeting
on February 20, 1964. Because of the proximity of the highways, and
the general character of the neighborhood, the Board is of the opinion
that the use proposed would be compatible with the area uses and
recommends the granting of the petition as requested.
