06-54COUNCIL FILE #: CJ�p' S� GREEN SHEET �: 3029208 RESOLUTION Presented By: Referred to: PAUL,NIINNESOTA !9 1 VJHEREAS, the City of Saint Paul has sponsored a Softball on Ice for some 20 + yeazs and is planning such an event 2 for February 4 and February 5, 2006 at Dean's Tavem and McCarron's Lake, located in the City of Roseville, 3 Ramsey County; and 5 WHEREAS, Dean's Tavem is supportive of this event on the condition that the City of Saint Paul indemnifies and 6 holds harmless its agents and officers; and 8 WHEREAS, the Saint Paul City Council finds that the Winter Camival Softball on Ice Tournament has legitimate 9 public purpose by drawing participants to Saint Paul and offering family entertainment to the citizens of Saint Paul; and 10 11 WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such a 12 purpose will facilitate and enable the event to take place; now, therefore, be it 13 14 RESOLVED, that the CiTy Council of the City of Saint Paul on behalf of the City of Saint Paul hereby agrees to defend, 15 indemnify and hold harmless Dean's Tavern from any and all damages it may be required to pay as a result of suits, 16 claims, actions, orjudgments arising out ofthe use of Dean Tavern as the host site for the 2006 Softball on Ice 17 Tournament, which are attributable to the negligent action or omission by the City of Saint Paul, its employees, agents or 18 contractors, and be it, 19 20 FURTHER RESOLVED, that the foregoing defense and indemnification does not cover: 21 22 23 24 25 26 27 28 29 30 31 i. Any occurrences or events which are not part of the Softball on Ice event and which do not occur or take place at Dean's Tavem and McCarron's Lake and during the course of the event. 2. Injuries or damages which arise from hidden traps or conditions existing on the grounds surrounding Dean's Tavern and McCarron's Lake of which Ramsey County or the City of Roseville had actual constructive notice. 3. Injuries which arise out of criminal actions, assaults, batteries or other acts of violence committed by any person or persons. 32 AND BE IT FURTHER RESOLVED, that nothing in the foregoing provisions shall be construed as a waiver of the 33 municipal tort liabiliTy limits set forth in Minn Stat.
