THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN,:
'I Section 1. That the Zoning Code, Chapters 60 t `�ry,4 inclusive,
of the Saint Paul Legislative Code, pertaining to Use Districts, Height
Districts, and Rezoning of, certain properties in the City of Saint Paul, as
amende,, be and the same is hereby further amended so as to rezone the
following described property from "A" Residence District to "C" Residence
District, to -wit:
Except Maryland Avenue and except the east 295.16 feet,
the SE 1/4 of SW 1/4 of SE 1/4 of Section 22, Range 22,
Township 29;
situated on the north side of East Maryland Avenue between Kennard and
Hazelilood Streets in Saint Paul.

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Districts, and Rezoning of certain properties in the City of Saint Paul, as
amended, be and the same is hereby further amended so as to rezone the
following described property from "A" Residence District to "C" Residence
District, to -wit:
Except Maryland Avenue and except the east 295.16 feet,
the SE 1/4 of SW 1/4 of SE 1/4 of Section 22, Range 22,
Township 293
situated on the north side of East Maryland Avenue between Kennard and
Hazeiwood Streets in Saint Paul.
Section 2. This ordinance is hereby declared to be an emergency

This is in reply to the referral by the City Council of the peti-
�ion of M. G. Hathaway to the Board of Zoning for a recommendation
ion the feasibility of rezoning certain property situated on the north
side of E. Maryland Avenue between Kennard and Hazelwood Streets from
its present classification of "A" residence to a "C" Residence district.
The subject property is described as except the east 295.16 feet, the
SEJ of SWJ of SEJ of Sec. 22, R. 22, Twp. 29.
On November 27, 1963, the Commissioner of Finance reported that the
petition was sufficient as the owners of 15 of the 21 parcels (71.42%)
of land situated within the prescribed 100 foot radius had acquiesced
in the petition. The site is a large rectangular tract having a front-
age of approximately 361.37 feet along Maryland Avenue and extending
to a depth of 626 feet producing an overall site area of slightly more
than 226,000 square feet, or 5.2 acres. Its characteristics can be
described as being a relatively level tract of land at about the street
grade of Maryland Avenue and is developed along the Maryland Avenue
frontage with a single- family residence and a one -car garage.
After hearing the petitioner and the report by the Planning Board
Staff, the Board discussed the merits of the petition. It was
brought out by a member of the Board that when the Fire Station south
of and across Maryland Avenue was constructed, the water table was
found to be three (3) feet below the grade of Maryland Avenue. It
was also the optiienof some Board members after they had viewed the
site that it would be best suited for apartment development rather than
single and two - family residences.
Based on these factors, the Board recommends that the Council re-
classify the subject property to a "C" residence district as requested.

You r�leferred to the undersigned for study and report the question
of the suitability of the development of certain properties on
Maryland Avenue on the SE 1/4 of the SW 1/4 of the SE 1/4, Sec.
22, 1. 29, R. 22, the approximate location being on the north side
of Maryland between Kennard and Barclay.
Thisiproperty is east of the pumping station of the Water Depart-
ment and directly across the street from a new fire station recent-
ly cronstructed. The soil borings of the property for the fire
station location indicate fill, silt, and loam to a depth of 29
feel In the construction of the fire station, piling was used,
drihen to a depth of 30 to 33 feet. This, of course, indicates
tha.1the soil has no bearing value.
The ji, ground water level also was approximately 3 feet below the
gra e o f Maryland Avenue.
Theilproperty in question, which is directly north and across the
street, is considerably lower, averaging 6 to 7 feet below the
level of Maryland Avenue. In some areas it is depressed still
fur her. Large areas have cattails growing in portions of the land,
indicating that there is water in there.
it , the opinion of the undersigned, based on the test borings and
also on discussions with the architects for the pumping station,
th't this area will require piling to support any type o* s�truczure
anllthe best estimate is that this piling will probably have to ex-
teqd from 40 to 45 feet. There is also a substantial amount of
file! required to bring this property up to the grade of Maryland.
These conditions are such that the cost of providing foundations
for; single family homes would be excessive and verb substantial.

We lave also been able to secure the test borings for the Hazel
Par Pumping Station and these test borings indicate the same
information and the same soil conditions as existed under the
firs station, which further strengthens the opinion that there
arelvery unsatisfactory soil conditions in this entire area and
will of necessity require piling.
