This is in reply to the referral of the appeal of Anton and Regina
Thell to establish a 16 foot building line setback from Park Street
, for property which is described as Lot 12 and all of Lot 13 except
, the south 30 feet thereof, Block 6, Hager's Sub. of Lots 1 thru 7
_ and 14 thru 18 of Walcott's Addition to Cottage Homes and which is
located on the west side of Park Street between Cottage and Arlington
Avenues. The subject property is zoned "A'� residence.
The site is presently vacant and it is proposed to develop it with a
single-family residence. The subject property has a frontage of 50
feet and a depth of 131.5 feet, resulting in an area of 6,575 square
� feet. Chapter 62 of the Legislative Zoning Code requires a building
setback of 26 feet for this property becau�e of its zoning classifi-
cation. It is the applicant's desire to maintain a 16 foot setback
as two of the three residences now in this block maintain a 15 foot
, setback.
, In considering this matter at its regular meeting on January 23, 1964,
the Board concluded that the requested 16 foot setback would not be
detrimental to the other properties in the block and would be in keep-
ing witb the purpose and intent of the Zoning Ordinance. It was there-
� fore recommended by the Board of Zoning that the 16 foot building line
setback as requested be granted on the above described property.

� We represent Anton and Regina Thell of 1426 Mayre Street, St. Paul 17,
' Minnesota, in appealing,from the application by the Building Department
' of the zoning code as the same affects the setback line requirements of �
the hereinafter described property. This appeal is taken under Chapter
� 64.03, Section A, Paragraph J. _
'� The property with which we are concerned is legally described as: Lot
� twelve (12) and all of Lot thirteen (13) except the South thirty (S 30) -
t feet thereof, Block six (6) , Hager's Subdivision of lots 1, 2, 3, 4, 5,
� 6, 7, 14, 15, 16, 17, 18, of Walcotts addition to Cottage Homes, accord-
� ing to the recorded plat thereof on file and of record in the office of
; the Register of Deeds in and for Ramsey County, Minnesota. This prop-
� erty is located on Park Street between Arlington and Cottage Avenues.
The land is presently vacant, and the appellants herein desire to con-
� struct a single family dwelling house thereon. The adjoining properties
' within the same block are confined to residential uses.

� The appeal is hereby made for the establishment of a setback distance
as to the appellants' premises of 16 feet, rather than 26 feet. We have
� attached hereto an approxima.te scale drawing of the appellants' property
and the ad�oining lots, intending to indicate the fact that the houses
� presently situated on each of the two lots next adjoining the appellants
, on the North are set back a distance of no more than 10 feet. Enforce-
' ment of the present standards of the zoning code would require that ap-
pellants' proposed dwelling be set back substantially farther than the
existing adjoining dwellings. Such a setback requirement substantially
�° diminishes the value of the appellants' property, and in no way benefits , �
the adjoining owners. The 16-foot setback requirement which appellants
request, would in no way adversely affect the adjoining owners and would
be consistent with existing development of the i�ediate area.
