Germain Street between Christie Place and Idaho Avenue East in Block 9 of
Tilsens's 6` Addition.
This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns shall pay $600.00 as an
administrative fee for this vacation which is due and payable within 60 days of the
effective date of this resolution.
2. That an easement shall be retained on behalf of Quest for an existing aerial cabie on
the west side of described vacation.
3. That an easement sha11 be retained on behalf of Comcast for existing aerial facilities;
and if improvements interfere with existing facilities or ComcasY s access to
maintain, repair or upgrade them, Petitioner or its successor shall assume all costs of
providing new easements or of relocating facilities to new easements.
4. That an easement shall be retained on behalf of Xcel Electric over, under and across
the above described properiy, specifically a 10.00 foot wide strip of land lying
parallel with, abutting to and east of the line of Lot 6, Block 9, Tilsen's 6�" Addition,
according to the recotded plat thereof on file and of record in the Office of the
Ramsey County Recorder.
That the petitioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims of
any character brought as a result of injuries or damages received or sustained by any person,
persons or property on account of this vacation,or the petitioners' use of this property,
including but not limited to, a claim brought because of any act of omission, neglect, or
misconduct of said petitioners ar because of any clanns or liability arising from any violation
of any law or regulation made in accordance with the law, whether by the petitioners or any
of their agents or employees.

That the petitioners, thelr successors and assigns shall, within 60 days of the effective date of
this resolurion, file with the City Clerk an acceptance in writing of the conditions of this
resolurion and shall, within the period(s) specified in the terms and conditions of this
resolution, comply in all respects with these terms and conditions.

RE: Public Works Vacation File No. 07-2006 (Vacate Alleys )
I recommend a public hearing before the City Council be held on June 7, 2006 to consider the
petition of Leonard Gramse.
This petition is to vacate a11ey rights in Germain Street from East Idaho Avenue to Chrisitie Place.
The purpose of this vacation is to improve property appearance with added green space, discourage
garbage dumping and build a shed partially within that area.
This property is located in City Council District 6, Plarniing District 2.
