An Ordinance amending the Zoning Code, Chapters
•60 to 64 inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts, Height Districts and
Rezoning of certain properties in the City of Saint Paul,
as amended. This is an emergency ordinance rendered
necessary for the preservation of the public peace, health,
and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclusive, of
the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts,
and Rezoning of certain properties in the City of Saint Paul, as amended, be
and the same is hereby further amended so as to rezone the following described
property from "A" Residence District to "C" Residence District, to -wit:
Lots 1 through 30, Block 10, and Lots 1 through 30,
Block 11, Rice Street Villas,

consisting of two separate tracts, each being an entire platted block and
being bound on the north by Hoyt Avenue, on the south by Nebraska Avenue,
on the west by Marion Street.-and on the east by Albemarle Street, the
two tracts being separated by unimproved Woodbridge Street.
Section 2. That Leonard W. Bisanz, and his successors and assigns,
if any, in respect of the ownership of the hereinabove described real estate
contemplated to be developed by the owner of the same by the construction
thereon of apartment buildings with'a- total,.of 320 units, shall, prior to
the construction of any such improvement of said real estate, give notice,
of the same to the Planning Board of the City-of Saint Paul and consider
recommendations of said Board for replatting of the - subject, ground area
and realignment of public streets therein calculatedeto provide better
;ayout plans for such proposed improvement.

two tracts being separated by unimproved Woodbridge Street,

Gentlemen:
The North End Business Men's Club is greatly interested in
having the North End. District of our City developedi with
homes or apartment buildings.
The area from Albemarle going west for several blocks and
from Arlington to Hoyt is generally a poor area to build
single homes because the soil is such that it requires
pilings. The cost of the pilings rules out the possibility
of this area being-developed into single family dewellings.
It is our understanding that the City of Saint Paul even lost
a street in this area.
We know there are several developers interested in budding
Apartments in this area if the property can be rezoned.
We feel this property could be developed rightly with apartments
beautifying the neighborhood, bringing business into our district
and adding tax revenue to our city's treasury.
We therefore ask the Saint Paul City Council to vote favorably
to rezone this porperty to "C" residence.

Nebraska Avenue; on the west by Marion Street and on the east by Albemarle
Streets. The two tracts are separated by unimproved Woodbridge Street.
Each tract has an area of 150,250 square feet, making a total of 300,500
square feet.
On January 2, 1964, the Commissioner of Finance reported the petition
sufficient with the owners of 36 of a possible 41 (87.8 %) tracts of land
within the prescribed 100 foot radius having signed the petition. The land
is vacant, reasonably level and varies from street grade to approximately
two feet below. It is proposed to develop the site with apartment buildings
with a total of 320 units. Field investigation and the records of the Public
Works Department indicate that a substantial portion of this area has peat
soil characteristics which, in some cases, extends to a depth of more than
twelve feet. A study of the area bounded by Wheelock Parkway on the north
and west, Rice Street on the east, and W. Arlington Avenue on the south
was made by the Planning Board staff for the purpose of considering the re-
platting of the entire area, and the possible realignment of some of the
streets for the benefit of the City of Saint Paul and to provide a better
layout for the proposed apartment development. The petitioner met with
the staff, and the suggestions were discussed at length.
The Board of Zoning considered the matter at its regular meeting on Jan-
uary 9, 1964, and after hearing the report of the staff, recommended
approval of the petition to rezone the above described property with the
suggestion that the petitioner consult with the staff regarding possible -
replatting and realignment of streets before proceeding with the develop -
ment of the property.
