This is an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. \ THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: \ Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "A" Residence District to "C" Residence District, to -wit: Lots 8 through 24, Block 12, Rice Street Villas being located on the west side of Marion Street and the east side of Galtier Street between Nebraska and Hoyt Avenues. Section 2. That Allied Enterprises, Inc., and its successors and assigns, if any, in respect of the ownership of the hereinabove described real estate contemplated to be developed by the owner of the same by the construction thereon of an 83 -unit apartment building, shall, prior to the construction of any such improvement of said real estate, give notice of the same to the Planning Board of the City of Saint Paul and consider recommendations of said Board for replatting of the subject ground area and realignment of public streets therein calculated to provide better layout plans for such proposed improvements. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for-the preservation of the public peace, health and safety. Section 4. This ordinance shall take effect and be in force upon its passage, approval, and publication. Riordan City Clerk Building Dear Sir: This is in the matter of the petition of Allied Enterprises Inc. to rezone from "A" to "C" residence property located on the west side of Marion Street and the east side of Galtier Streets between Nebraska and Hoyt Avenues which is described as Lots 8 thru 24 inclusive, Block 12, Rice St. villas. SID 4 On January 2, 1964, the Commissioner of Finance reported the petition sufficient with the owners of 20 of a possible 22 (907o) tracts of land within the prescribed 100 foot radius having signed the petition. The subject property consists of 17 platted lots, separated by a platted alley for a total area of approximately 85,135 square feet. The property is vacant, reasonably level and varies from street grade to a maximum of two feet below. It is proposed to develop the site with an apartment development with a total of 83 units. Field investigation and the records of the Public Works Department indicate that a substantial portion of this area has peat soil characteristics which in some cases extends to a depth of more than twelve feet. A study of the area bounded by Wheelock Parkway on the north and west, Rice Street on the east and W. Arlington Avenue on the south was made by the Planning Board staff for the purpose of considering the replatting of the area and the possible realignment of some of the streets for the benefit of the City of Saint Paul, and to provide a better layout for the proposed apartment development. The petitioner met with the staff and the suggestions were discussed at length. The Board of Zoning considered the matter at its regular meeting on Jan- uary 9, 1964, and after hearing the report of the staff, recommended approval of the petition to rezone the above described property,with the suggestion that the petitioner consult with the staff regarding possible replatting and realignment of streets before proceeding with the develop- ment of the property.
