WHEREAS, Josh Krsnak, Zoning File 05-200-780, has submitted for City Council approval the attached
Registered Land Survey (RLS) to create 3 tracts within an existing parking garage, at the 245 East 6th
Street, on the northwest corner at Wall; and
WHEREAS, the appropriate Ciry departments have reviewed the RLS and found, subject to the
recommended condition, that it meets the requirements of Chapter 69 of the Zoning Code; and
WFiEREAS, notice of public hearing before the City Counci{ was duly published in the o�cial newspaper of
the City on November 25, 2005, and notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the subject property; and
WF{EREAS, the City Counci4 held a public hearing on the proposed RLS an December 21, 2005, at which all
interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the RLS;
NOW, THEREFORE BE IT RESOLVED, that the Ciry Councii accepts and approves the attached RlS for
River Park Lofts subject to the condition that the appiicant shall file a copy of the Councit Resolution
approving the RLS with the Ramsey County Recorder's Office.

Street and now recommend approval. The City Councii has until March 8, 2005, to adopt a
resolution either approving or disapproving the final RLS. A staff report will be prepared and
provided to the Council the week prior to the public hearing.
I have confirmed this day with Councilmember Thune's office. My understanding is that this
pubiic hearing request will appear on the agenda for the December 21, 2005, City Council
meeting and that you will publish notice of the hearing in the Saint Paul Legal Ledger at least 10

E. ZONING CODE CITATION: §69.705 states that "all registered land surveys that constitute a
subdivision as defined in this chapter shall be subject to the provisions herein contained". §69.406
provides criteria for review of subdivision applications.
F. HISTORY/DISCUSSION: On August 30, 2005, Hempel Properties acquired the former Lowertown
Business Center and the adjacent vacant fire station, at the corner of Wacouta and 6'" Street. The
former Business Center is being converted into River Park Lofts, consisting of 120 owner-occupied
units. The former fire station on the southwest side of the site wi11 be converted into a parking
garage. The condominium development wiil include parking for 122 cars. Because it is not
possible to accommodate all of the parking needed within the main buiiding and fire station the
applicant has purchased the loading dock area of the adjacent parking ramp. The former loading
dock wilt be converted into an encfosed two level parking structure. The first floor of the main
building will have access off of Wail Street. Access to the second floor will be off of East 6`" Street.
There will be a parking easement agreement with the building owner for access to the second
floor.
G. DISTRICT COUNCIL RECOMMENDATION: The District 17 Community Council had not
commented at the time this staff report was prepared.
H. REQUIRED FINDINGS:
1. §69.406 of the Zoning Code requires that all of the following findings shall be made prior to
approval of a subdivision:
(1) All the applicable provisions of the Legislafive Code are complied with. This finding is met.
City staff have reviewed the proposed subdivision and have determined that all appiicable
provisions of the City Code are met.

(2) The proposed subdivision will nof be detrimental to the present and potential surrounding
land uses. This finding is met. The proposed RLS will not be detrimental to present and
future use of the surrounding land. The area surrounding this site is fully developed to
include a parking ramp, commercial buildings, and high density housing. The continued use
of this site as a parking ramp will be consistent with the way the area has developed and wiil
not be detrimental to the surrounding land uses.
(3) The area surrounding the subdivision can be planned and developed in coordinafion and
compatibility with the proposed subdivision. This finding is met. The site and the area
surrounding the proposed RLS is aiready developed as a parking garage, high density
housing, commercial buildings, and Mears Park. The proposed RLS will be contained within
the footprint of the existing parking garage and wili not impact the surrounding properties_
(4) The subdivision is in conformance wifh the Comprehensive Plan. This finding is met. The
Transportation Plan states that the City should work to provide an adequate supply of
parking in downtown by ensuring parking availability to attract new tenants (Policy 61). The
Hisforic Lowertown Small Area Plan (1994) identified the need to improve traffic and parking
to accommodate the continued growth of housing in this thriving urban neighborhood (pg. 3)
(5) The subdivision preserves and incorporates the site's imporfant existing natura! features
whenever possible. This fnding is met. The site is in a fulty developed area of the City. There
are no remaining naturai features on this site that will be disturbed by the RLS.
(6) All land intended for building sites can be used safely wifhout endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
This finding is met. The site is flat with stabie soil conditions, and there is already a parking
garage on this site. The proposed RLS can be used safely without endangering residents in
the surrounding area.
(7) The subdivision can be economically served with public facilities and services. This finding is
met. The site is already economically served with public facilities from the surrounding
streets.
STAFF RECOMMENDATION: Based on the required findings staff recommends approval of the
final RLS for the property located at 245 East 6'" Street subject to the condition that the applicant
shall file a copy of the Councii Resolution approving the RLS with the Ramsey County Recorder's
Office.

This letter is intended to help explain and give details about our condominium project in
Lowertown St. Paul, Minnesota. River Pazk Lofts is Lowertown's latest redevelopment
project. Hempel Properties of Plymouth, Minnesota acquired the vacant former
Lowertown Business Center and the adjacent vacant former City of St. Paul Fire Station �
from GMT Corporation on August 30, 2005 for $5,520,000. The properties aze in the
process of being reconditioned and converted into residential condominiums.
General Descrintion ofProiect
River Pazk Lofts consist of 120 owner-occupied loft condominium units situated in a 7-
story "turn-of-the cenhuy" office/wazehouse building and an attached retired firehouse in
St. Paul, Minnesota. The renovation is a true loft conversion meanina that each unit will
have eacposed concrete floors, e�osed heavy timber ceilings, e�osed brick walls, and
exposed HVAC duct work. Each unit will also possess at least one partially enclosed
bedroom and bathroom wifh the balance of the space being of an open environmettt.
The main building is of heavy timber construction with a light brown brick veneer. Cast
iron columns aze used in the lower three floors and basement Wood columns occur from
the 3 floor through the 7�` floor. The building is currenfly vacant except for the two �
condominium models showcased on the 1� floor. The remainder of the building interior is

. in the process of being demolished and abated.
The attached rerired firehouse is of brick and timber construction. The two-story structure
was built in 1921 used by the city of St. Paul Fire Department until 1971.
The development will include pazking for 122 cazs. Because it was not possible to
accommodate pazking for ail 122 cars within the main building and fuebam, Hempel
Properties (on behalf of RPL Condos, LLC) negotiated with the owner of the adjacent
pazking ramp to purchase the "loading dock azea" of his ramp. This loading dock area
previously served as the main building's shipping and receiving area. However, since the
main building and firebam are being converted into residential housing, the need for a
shipping and receiving azea has gone away. Consequently, this loading dock area is now
being converted into an enclosed "in-fill" pazking structure. This enclosed pazking
siructure will consist of two levels of heated, secured pazking. Vehiculaz access to the I
oor of the new in-fill parking structure (cunent loading dock), for the I floor of the
main building, and for the 1 S ` floor of the fire bam will be direcfly from Wall Street.
� Vehiculaz access to the 2" oor of the in-fill pazking structure and the lower level of the
main building will be direcfly from East 6�' Street. There will be pazking access easement
agreements with the Owner of the adjacent pazking shvcture for access to the 2 floor of
the in-fill pazking structure. A copy of this easement is attached to tkus letter
