Registered Land Survey Approval for Oxford Hill
WHEREAS, Oxford Hill Deve4opment Group, LLC., Zoning Fite 05-205-764, has submitted for City
Council approval the attached Registered Land Survey (RLS) to create 19 mixed use tracts at
1046-1060 Grand Avenue, on the southwest corner at Oxford; and
WHEREAS, the appropriate City departments have reviewed the RLS and found, subject to the
recommended condition, that it meets the requirements of Chapter 69 of the �oning Code; and

WHEREAS, notice of pubiic hearing before the City Council was duly published in the official
newspaper of the Ciry on December 8, 2005, and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the subject property; and
WHEREAS, the City Council held a pubiic hearing on the proposed R�S on December 21, 2005, at
which all interested parties were given an opportunity to be heard, the Council having considered ail
the facts and recommendations concerning the RLS;
NOW, THEREFORE BE IT RESOLVED, that the City Council accepts and approves the attached
RLS for Oxford Hill Development Group, LLC., to create 19 mixed use tracts subject to the condition
that the applicant shall file a copy of the Council Resolution approving the RLS with the Ramsey
County Recorder's Office.

and provided to the Council the week prior to the public hearing.
I have confirmed this day with Councilmember Thune's office. My understanding is that this
public hearing request will appear on the agenda for the December 21, 2005, City Council
meeting and that you wili publish notice of the hearing in the Saint Paul Legal Ledger at least 10

E. ZONING CODE CITATION: §69.705 states that "all registered land surveys that constitute a
subdivision as defined in this chapter shall be subject to the provisions herein contained". §69.406
provides criteria for review of subdivision applications.
F. HISTORYlDISCUSSION: The applicant acquired two parcels for demolition at the southwest
comer at Grand and Oxford. The first parcei, a former gas station, was purchased in 2001, and the
second parcet, a commerc+al buitding was acquired in 2003. tn 2004, the applicant began
construction on Oxford Hill, which is now nearing comp�etion. Oxford Hill will have four commercial
tenants on the main floor and a totai of 31 condominium units on Yhe second, third and fourth
floors of the building. There will be approximately 100 underground parking stalls and 26 at-grade
parking spaces in the rear of the building. The applicant as applied for an RLS to divide Oxford Hill
into 19 tracts. The newfy created tracts will divide the parking aYeas and create separate common
use areas within in the building such as stairwells and lobbies.
G. DISTRICT COUNCIL RECOMMENDATION: The District 16 Community Council had not
commented at the time this staff report was prepared.
H. REQUIf2ED FINDINGS:
1. §69.406 of the Zoning Code requires that all of the following findings shall be made prior to
approval of a subdivision:
(1) All the applicable provisions of fhe Legislative Code are complied with. This finding is met.
City stafF have reviewed the proposed subdivision and have determined that all applicable
� provisions of the City Code are met.

(2) The proposed subdrvision will not be detrimentaf to the present and potenfial surrounding
land uses. This finding is met. The proposed RLS wili not be detrimental to present and
future use of the surrounding land. The area surrounding this site is fully developed to
inciude a mix of commercial buildings, mixed density housing and parking areas. The
continued use of this site as a mixed use building will be consistent with the way fhe area has
deveioped and wilf not be detrimenta[ to the surrounding tand uses.
(3) The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed su6division: This finding is met. The site and the area
surrounding the proposed RLS is already developed. The proposed RLS will be contained
within the foofprint of the new buiiding and wil( not impact the surrounding properties.
(4) The subdivision is in conformance with the Comprehensive Pfan. This finding is met. The
Land Use chapter of the Comprehensive Plan states that "the City will support compatible
mixed use within single buiidings and in separate buildings in close proximity" (Objective
5.2.1). The District 16 P(an (1989} atso supporfs a mix of commercial and residentiaf uses
along Grend Avenue (pg. 2).
(5) The subdivision preserves and incorporates fhe site's important exisfing nafural features
whenever possible. This finding is met. The site is in a fully developed area of the Ciiy. There
are no remaining nafuraf feafures on this sife thaf wifi be disturbed by fhe RLS.

(6) Alf land intended for building sites can be used safely without endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace.
This finding is met. The site is flat with stable soil conditions, and there is already a mixed
use residentia! and commercia( building with underground parKing on this site. •
(7) The subdivision can be economically served with public facilities and services. This finding is
met. The site can be served with public facilities from suROUnding streets.
STAFF RECOMMENDATION: Based on the required findings staff recommends approval of the
final RLS for the property located at 1046-1060 Grand Avenue subject to the condition that the
appiicant shall file a copy of the Councii Resolution approving the RLS with the Ramsey County
Recorder's Office.
