Dear Sir:
This is in the matter of Wm. H. Weitaman's 1) appeal to relax the density
standards of Chapter 60.24 to permi��Yre-c�onstruction of a 26-unit apart-
ment structure on a lot of insuff icient area, and 2) an application for a
26-car off-street parking lot on property located on the ,south side of
Marshall Avenue between Howell and Dewey Streets which is described as
Lots 6, 7, 8, Block 2, Merri�m Park Second Addition. The property is
zoned "C" Residence.
On July 23, 1964, the City Council approved a 25-car off-street parking lot
in conjunction with a proposed 25-unit apartment building on the subject
property subject to certain provisions relative to fencing. The �pplicant
now is requesting to increase the size of the parking lot from 25 spaces
to 26 spaces, and also is asking permission to construct a 26-unit building
on the site which has an area �of 25,350 square feet. The Legisl.ative Zoning
Code requires a minimum lot area of 1,000- square Peet for each �t�it.TtI�:��s,
therefore, required that the applicant obtain Council approval. before pro-
ceeding with the development for 26 units.
The Board of Zoning considered this matter at its regular meeting on August 6,
1964. After due consideration, the Board concluded that there �was not justi-
fication for the relaxation of the density standards to permit more than a
25-unit apartment development. The applicant's plan indicates that there is
sufficient space on the site to provide 26 off-street parking spaces. There-
fore, the Board of Zoning recammends the denial of the appeal to relax the
density standards as requested and approval of the request for 26 off-street
parking lot/in accordance with plans received May 14, 1964.

application for �special Council use permit with respect to ..
the above project together with three prints of the preliminary
plan and my ,check in the sum of $26.00 as filing fee.
Please also consider this application an appeal from the
requirements of Section 60.24 of the Legislative Zoning Code
with respect to the requirements of a minimum of 1 ,000 square
feet of land area for each dwelling. It is felt that 26 units
is a reasonable use of the property in the manner set forth on
the plan and that the slight variation from compliance with the
density requirements should be waived.
