ldhereas, The City and State of Minnesota have agreed to build a cooperative
storm water relief sewer project identified as ST. ANTHONY PARK STQRM WATER RELIEF
CONTRACT �'A" to drain the I .H. 94 and T.H. 280 complex as well as draining other. property
in the northeast part of the City said contract work to be let by the City, and
- Whereas, The State of Minnesota has requested the City to include as part of
said contract, as a condition of their approval of plans, the construction of a by-pass
of the Wabash Avenue sewer, and
Whereas, By Agreement No. 54328 the State has agreed to pay all of the
contract costs for said by-pass sewer because of the benefit to the States' contractor
building the Wabash bridge as part of I.H. 94 construction, and
Whereas, To build said by-pass sewer the Minnesota Transfer Railway Company
must remove a portion of their south track in Wabash Avenue and also must construct a
temporary track change to temporarily re-route the rail traffic around the sewer
construction and,
, Whereas, The City Council by Ordinance No. 2728, approved November 21 , 1907,
granted permission to the Minnesota Transfer Railway Company to locate in Wabash Avenue
and said Ordinance saves the City harmless from costs and expenses that the Minnesota
Transfer Railway Company may incur for removal and modification of their tracks, and
4lhereas, In consideration of the aforesaid Ordinance, the State of� Minnesota
has informed the Commissioner of Public Works that �he State of Minnesota cannot reimburse
the Minnesota Transfer Railway Company for the aforesaid removal and modification of
their tracks, therefore be it •
Resolved, That the Commissioner of Public Works notify the Minnesota Transfe�:
Railway Company to remove and relocate their tracks in Wabash Avenue, as required to
accomodate the construction sequence schedule in the aforesaid Contract, said track
cPaanges to be accomplished at no cost to t he City or State. _
